URGENT ACTION - TWO ACTIVISTS FROM SINTRAMUNICIPIO YUMBO WOUNDED 
================================================================

The Association for Research and Social Action NOMADESC and the
organisations affiliated to the National and International Human Rights
campaign Against Corruption, Privatisation and the Criminalisation of
Social Protest denounce and condemn the assassination attempt against
two members of the Municipal Workers Union of Yumbo in the early hours
of this morning the 3rd of May. 

THE EVENTS:

1. At around 12:30 in the early hours of the 3rd of May, two
workers of the Yumbo Municipal Workers' Union SINTRAMUNICIPIO YUMBO
CARLOS HERNAN SÁNCHEZ DIAZ and ANTONIO ZAMANETE supervisor and assistant
respectively were victims of an assassination attempt by a group of men
who fired at them. The workers and trade union activists were carrying
out their duties of visiting work sites, schools, the Municipal Prison,
and Colleges of the Municipality when they were fired at. 

2. The events occurred in the Barrio la Trinidad, Kr. 4 este, near
to the Bridge called "El Muelle", a place where the community has
denounced several times the presence of armed men who appear to belong
to a Paramilitary group that has been operating in the Municipality of
Yumbo, and who are responsible for tens of assassinations in the area. 

3. The report of the events presented by the Yumbo Police is that there
was a robbery attempt. However, all the belongings of the workers: cell
phones, wallets, watches and there motorbike were not taken. This would
seem to discredit this version of events.

4. The wounded activists were taken to hospital, one to the Departmental
Hospital of Cali and the other to the Versailles Clinic where they are
both in a serious condition 

5. It is important to note that in the last weeks the trade union has
been subject to death threats and members have been followed. The reason
for this is that workers from the union have been carrying out meetings
in the mornings and the afternoons in order to demand that the Municipal
Administration fulfils its obligations under the terms of the workers
Collective Agreement which has been broken under the Mayor ALBA LETICIA
CHAVEZ JIMÉNEZ. Workers have not received their annual salary increase
for this year, they have not received their 'dotacion' (uniforms and
other items), workers who have left in the last two years have not been
replaced among other items. Likewise the Mayor has demonstrated her
intention to privatise and to continue to employ contractors in
positions which were previously carried out by Municipal Workers. 

6. As is well known well known, trade union leaders in Yumbo have been
constant victims of death threats, via telephone, leaflets sent to the
union headquarters , and on the 9th of June, 2000 were victims of a
letter bomb which fortunately was deactivated. All these events have
produced denouncements filed to the appropriate authorities, but remain
in total impunity. 


SECURITY SCHEMES

Additionally, it is extremely worrying that there have been several
confrontations between public forces, trade union leaders and their
security schemes (*). An example of which occurred on the 19th of April
with the President of Sintramunicipio Yumbo JAIME SÁNCHEZ who whilst in
the public establishment "El Mirador" with members of his security
scheme located on Kr 3 with 5 and 6 in the Municipio of Yumbo faced the
following situation. 

At 10:30 p.m. a police patrol car arrived No. 2038, commanded by
sergeant Medina accompanied by four more agents who headed directly
towards EFRÉN NARVÁEZ, the bodyguard of the union leader and demanded
identification papers. When he explained that he was an agent of the
DAS security scheme the Sergeant replied aggressively that he had
nothing but a simple contract (*). 

The union leader Jaime went to talk to the police to explain who he was
and what job EFRÉN NARVÁEZ was carrying out, and the response of one of
the police was to put a gun in his face. The trade union leader
immediately attempted to contact the Ministry of Interior, via walkie
talkie, but there was no response. He then called the walkie talkie of
Dr. MAXIMILIANO SÁNCHEZ, co-ordinator of the FONADE (National Fund for
Development) programme, whom he informed of what was happening. 

Dr. MAXIMILIANO SÁNCHEZ asked JAIME SANCHEZ to pass the walkie talkie
to Sergeant Medina who replied that he "wasn't going to talk to no son
of a bitch". The union leader had the walkie talkie on active and Dr.
SÁNCHEZ heard everything, so the Sergeant was forced to talk to him. The
Sergeant said that it was just a routine situation, that there was no
problem and left the premises. 

This situation is worrying in that on a range of occasions bodyguards of
trade union leaders have been treated badly, not respecting the Security
Scheme of the Ministry of Interior and DAS and not allowing them to
carry out their official functions as bodyguards of threatened trade
union leaders. 

For the above reasons we call for:

The carrying out of a quick and comprehensive investigation to establish
who are the material and intellectual authors of this attack against the
SINTRAMUNICIPIO YUMBO workers CARLOS HERNAN SÁNCHEZ DIAZ and ANTONIO
ZAMANETE.

Demand that the Colombian government in line with Directive 07, provides
a written response to explain why the Public Forces, the Army, the
police and other state security organs follow and harass trade union
leaders

Demand that regional authorities produce a public document where they
commit to respecting the work of trade union and human rights leaders in
the region. 


(*) The Security Schemes are chosen by threatened trade unionists and
are part of the agreement of the Colombian Government to protect people
who are at high risk of being assassinated. In the beginning they were
directly contracted by DAS (Department of Security Administration), and
paid through the budget of the Protection Programme, and provided with
9mm pistol, a bulletproof vest, a car, a walkie talkie and a DAS
Indentity card which explained their function. 

Their contracts have now been changed to a simple service contract,
which negates any responsibility on the part of DAS, which has created
many problems for the carrying out of their duties and also for their
social security. They are now unable to search suspicious people, they
have no police function, and they have been forced to give up their DAS
logo on bullet proof jackets and arm bands. It is important to remember
that when they had these previous abilities, they could capture and
detain suspicious people including government agents carrying out
surveillance of trade union leaders.

ACCION URGENTE
==============

HERIDOS DOS TRABAJADORES ACTIVISTAS DE SINTRAMUNICIPIO YUMBO
============================================================

Las Asociación para la Investigación y Acción Social Nomadesc y las
organizaciones miembros de la Campaña Nacional e Intencional de Derechos
Humanos, contra la privatización, la corrupción y la penalización de la
protesta social, abajo firmantes, denunciamos y condenamos el atentado
del que fueron víctimas los trabajadores del Municipio de Yumbo en la
madrugada del día de hoy 3 de mayo.

LOS HECHOS:

1. Siendo las 12:30 de la madrugada a amanecer el 3 de mayo de 2002,
fueron objeto de un atentado por hombres armados que les dispararon
tiros de fusil, los trabajadores del Municipio de Yumbo CARLOS HERNAN
SÁNCHEZ DIAZ y ANTONIO ZAMANETE supervisor y auxiliar de recorrido
respectivamente. Los trabajadores y activistas sindicales se encontraban
de turno y realizaban la ronda por los puestos de trabajo, escuelas,
puestos de salud, colegios y cárcel municipal, cuando fueron
sorprendidos por los impactos de fusil.

2. Los hechos ocurrieron en el Barrio la Trinidad, Kr. 4 este, cerca al
puente del sitio conocido como "El Muelle", lugar que ha sido denunciado
por la comunidad por el constante movimiento de hombres armados al
parecer pertenecientes al grupo paramilitar que viene operando en el
municipio de Yumbo y que es responsable de decenas de asesinatos en esta
localidad.

3. El reporte emitido frente a los hechos por parte de Policía de Yumbo
es que el atentado se presenta por que los querían robar,
paradójicamente, las pertenencias de los trabajadores, celulares,
billeteras, relojes y la moto aparecieron en el sitio de los hechos, lo
que descarta esta versión de la policía.

4. Los activistas heridos fueron recluidos uno en el hospital
departamental de Cali y otro en la Clinica versalles y se encuentran en
estado grave de salud. 

5. Es importante anotar que en las ultimas semanas el seguimiento y
amenaza contra la organización sindical se ha aumentado en razón a que
los trabajadores han emprendido jornadas de mítines en las mañanas y en
las tardes, para exigir a la Administración Municipal se haga efectivo
el aumento salarial del presente año, se cumpla con la Convención
Colectiva de Trabajo la cual se viene violando por parte de la Alcaldesa
ALBA LETICIA CHAVEZ JIMÉNEZ, al no hacer efectivo el aumento salarial
para el presente año, no entregar la dotación a los trabajadores, no
haber remplazado las vacantes que han quedado en dos últimos años,
entre otros puntos. Igualmente la alcaldesa ha planteado su intención
de privatizar y continuar empleando contratistas en cargos y ocupaciones
que anteriormente eran desempeñados por los trabajadores del municipio.

6. Como es ampliamente conocido los dirigentes sindicales de Yumbo han
sido víctimas de constantes amenazas de muerte, llamadas telefónicas,
envió de panfletos a la sede del sindicato, así como el envió del libro
bomba el 9 de junio de 2000, que por fortuna fue desactivado, todos
estos casos han sido motivo de acciones urgentes y denuncias ante las
autoridades competentes en el pasado, pero han quedado en la total
impunidad 

ESQUEMAS DE SEGURIDAD 

Adicional a esta situación es profundamente preocupante que se presenten
constantes choques con la fuerza pública, los directivos sindicales y
sus esquemas de seguridad * como el sucedido el pasado viernes 19 de
abril con el presidente de Sintramunicipio Yumbo JAIME SÁNCHEZ, quien se
encontraba en compañía de sus escoltas de confianza en el
establecimiento público "El Mirador" ubicado en la Kr 3 con calles 5 y 6
del Municipio de Yumbo.

A eso de las 10:30 p.m. del día en mención llego la Patrulla de la
policía No. 2038, comandada por el sargento Medina y cuatro agentes más
quienes se dirigieron directamente donde estaba EFRÉN NARVÁEZ, escolta
del directivo sindical y le pidieron los papeles, cuando él manifestó
ser escolta del D.A.S. el sargento le manifestó agresivamente, usted
es un simple contratista. 

El directivo salió ha hablar con los agentes de policía y a explicarles
quien era el y que función cumplía EFRÉN NARVÁEZ, y la reacción de uno
de los agentes de policía fue desasegurar el arma ponérsela de frente.
El directivo inmediatamente intento comunicarse con el mayor Herrera
(responsable esquima de seguridad DAS) o con el Ministerio del Interior,
por vía Avantel, pero se encontraban en Usuario no disponible, motivo
por el cual marco al Avantel del Dr. MAXIMILIANO SÁNCHEZ, coordinador
del programa de FONADE (Fondo Naccional de Desarrollo), a quien le
informo lo que estaba sucediendo. 

El Dr. MAXIMILIANO SÁNCHEZ le solicitó a JAIME SNACHEZ que lo
comunicara con el Sargento Medina y la respuesta del sargento fue "yo
no voy hablar con ningún h.p". El directivo que tenia el Avantel en
privado activo el parlante y el sargento medina se vio obligado a pasar
al radio, manifestando al coordinador de FONADE que era una situación de
rutina, pero que no había ningún problema y procedió a irse del lugar.

Esta situación se torna alarmante, ya que en varias oportunidades a los
agentes escoltas de los directivos sindicales, se les viene irrespetando
y aun el programa de protección del Ministerio y el DAS no aclaran las
funciones y facultades que tienen los escoltas de los dirigentes
sindicales. 

Por lo anteriormente descrito solicitamos:

Realizar una pronta y exhaustiva investigación que establezca quienes
son los autores materiales e intelectuales del atentado en contra de los
trabajadores del Municipio de Yumbo CARLOS HERNAN SÁNCHEZ DIAZ y ANTONIO
ZAMANETE.

Exigir al gobierno colombiano, con base en la directiva 07, responda por
escrito porque la fuerza publica, Ejercito Nacional, Policía y miembros
de organismos de seguridad del estado, persiguen y hostigan y agreden
permanentemente a los dirigentes sindicales y de derechos humanos. 

Se expida por parte de las autoridades regionales un documento público,
donde se comprometan a respetar la labor que los dirigentes sindicales y
de derechos humanos de la región.


* Los esquemas de seguridad son elegidos por los sindicalistas
amenazados y hacen parte del compromiso del Gobierno Colombiano en
materia de protección con las personas que se encuentran en alto riesgo
de ser asesinados, inicialmente los escoltas que hacen parte de estos
esquemas eran contratados directamente por el Departamento
Administrativo de Seguridad D.A.S., y pagados con presupuesto del
programa de protección, ellos portan una pistola 9mm, chaleco, vehiculo,
radio de comunicación y un carnet del DAS en donde se especifica su
función. Actualmente el tipo de contratación fue trasformada por un
contrato de prestación de servicios en donde el DAS, no asume ninguna
responsabilidad, eso a generado dificultades tanto para el cumplimiento
de sus funciones de protección, como para su seguridad social,
impidiendo por ejemplo requizar personas sospechosas, sin potestad de
ejercer funciones de policia judicial, les obligaron a entregar los
emblemas del DAS que portaban en los chalecos o como brasaletes e
igualmente les cambiaron los carnet. Es importante recordar que cuando
tenian estas funciones, ellos pudieron detectar y capturar personas
sospechosas y agentes de seguridad del estado que hacian inteligencia a
los dirigentes sindicales.
