Comrades, receive our fraternal greetings.

As feared the situation has got worse in the last few days as a result
of the mal-intentioned publications in El Pais newspaper. As we said in
the last message we are doing a series of legal actions and public
denunciation, as well as preparing for a high level meeting. yesterday's
Press Conference got good coverage and has had some effect.

With this message we are sending the most recent Urgent Action in which
we recap on El Pais's marking us out, and new facts are included because
they are alos about the attempt to delegitimise us and make us illegal.
SINTRAEMCALI's defence and denunciation has been very strong against
this violation of human rights in the city of Cali and the region.

We include some background, that is pertinent to mention, although they
have appeared in previous actions, because we believe it is important to
underline the way in which these vents show a systematic policy that has
been pursued to achieve the privatisation of EMCALI E.I.C.E. and the
stigmatisation of organisations that defend human rights.

However we are not discouraged. The renewed support of the community has
been important and next Thursday they are going to demonstrate publicly,
as in "The Dream of the Escalinatas" by Jorge Zalamea, that our
constituency grows anew.

II.     URGENT ACTION

SUSPICIOUS MEN PURSUE SINTRAEMCALI AND NOMADESC ASSOCIATION DURING THE
SAME WEEK THAT THE TRADE UNION ORGANISATION HAS BEEN MARKED OUT BY EL
PAIS NEWSPAPER

The Association for Investigation and Social Action NOMADESC and the
below signed organisations, all members of the National and
International Human Rights Campaign Against Corruption, Privatisation
and the Criminalisation of Social Protest, denounce to the national and
international community the serious events that have occurred in the
week from 30th June to 8th July 2002. These events increase the
systematic persecution, targeting, threats, psychological torture and
the assassinations that have been suffered by SINTRAEMCALI, community
leaders in the city and their advisers, since 29th January 2002 when the
agreement was signed by the Colombian government to stop the
privatisation of Cali's Municipal Corporation EMCALI E.I.C.E....

The demand for correction was responded to in the following terms by the
head of the Legal Department of "El Pais" newspaper, CAROLINA ESCRUCERÍA
C. "You cite the President of the Republic's directive No. 07 issued on
12 November 1999, directed at public servants. Obviously this does not
relate to EL PAIS which does not have the status of PUBLIC SERVANT, and
for this reason the directive is not applicable to us. Perhaps you
intend that the directive applies to the councillors, which is why we
recommend that you send to them your legal concerns." ...

[A Suspicious Incident]
-----------------------
At approximately 11am on 4th July 2002 a man arrived at the office of
lawyer Hermes Sánchez. This man was between 38 and 42 years old, between
1.62m and 1.65m tall, he had white complexion, was heavily built but
athletic, with short grey hair and wearing glasses. He called himself
Eduardo and said that he was a worker with SINTRAEMCALI. This man had
come with the supposed purpose of, according to him, presenting the work
that he had been doing for the union.

At the start of this conversation with the lawyer this man said, "that
he had been in the M-19 and that did he [Hermes - CSC] not remember him
from the time up in the hills" [Implying that the lawyer and this person
both had a past in the M-19 guerilla movement - CSC]. In the face of
this assertion, the lawyer stated that for many years he had represented
social processes, that he had been councillor for the Conservative
Party, and he had been a representative of civil society in the peace
process with M-19, and that he did not recall ever seeing this man.
Insisting that they already knew each other, this man asked the lawyer
in which project he had been involved, and that if he remembered that he
was a friend of Carlos, the one at the University, who had just arrived
from Europe.

With regard to this last comment it is important to note that National
and International Human Rights Campaign Against Corruption,
Privatisation and the Criminalisation of Social Protest, co-ordinating
NOMADESC, SINTRAEMCALI, the Committee for Solidarity with Political
Prisoners, and the Valle de Cauca CUT Regional Committee, as well as
other social organisations and trade unions in the region, had Carlos
Gonzalez as our representative in Europe. Carlos is the Auditor of
SINTRAUNICOL Valle (University Workers Union) and a member of the CUT
National Committee. Carlos Gonzalez's tour lasted from 29th April to
23rd June 2002, in which time he participated in the ILO conference in
Geneva, Switzerland, amongst others.

The individual insisted that it was very important that they are linked
with the work of SINTRAEMCALI and its Human Rights office, and that they
were carrying out some new projects, that the union was giving talks
that they could link themselves with, as well as their work with the
displaced. The lawyer stated that he was not interested in these matters
and that for now he was dealing with demands concerning corruption, and
advising on legislative reform, and that he was not interested in what
he was being told.

The man said to the lawyer not to be afraid, because if the lawyer
needed to leave the country, he could talk to Berenice, who could
arrange for him to leave the country. Did he know her? The lawyer stated
that the only Berenice he knew was in the work of Edgar Alan Poe. Then
the guy said no, he was talking about the Berenice working in human
rights, who could be found on the third floor of the union office, and
if not there then through the José Alvear Restrepo Collective
[Colombia's pre-eminent group of human rights lawyers based in Bogotá -
CSC]. The lawyer stated that he had no interest in leaving the country.
The man said: "Look, we are speaking very clearly that we are working
with the guerilla, we bring wounded guerilla fighters and we cure
them, all of this is co-ordinated with them". At this point the lawyer
interrupted, stating again that he had no interest in speaking of these
things that did not interest him at all and that his role was as a legal
advisor.

The man continued insisting that they had been able to link him as an
adviser to the union, saying things for example that Policarpa
Salavarrieta and José Hilario López had done it and why could we not do
it now. The lawyer stated that he had no more time and the man left.

We emphasise that nobody in SINTRAEMCALI, NOMADESC or in the Human
Rights Department or in the National and International Human Rights
Campaign Against Corruption, Privatisation and the Criminalisation of
Social Protest knows this man who called himself Eduardo, and that he
does not work in any of our offices.

It also seems strange to us that this individual should go to the
offices of HERMES SÁNCHEZ, who has not directly advised SINTRAEMCALI.
Although we also note that two of the colleagues sharing this lawyer's
office have advised SINTRAEMCALI in the past on presenting demands
against corruption, these were presented inside EMCALI, E.I.C.E.

· the attempt on BERENICE CELEYTA and a student just after they left
SINTRAEMCALI's office on 18th April 2002

· the police assault on SINTRAEMCALI and other union leaders on the May
Day demonstration that left JESUS GONZALEZ, Director of the CUT Human
Rights Department in intensive care.]


WE ASK FOR:

Because of the above we ask all of you to:


· Demand that "El Pais" newspaper, rectifies on its front page the news
that it has published and that ther be respect for social, popular,
trade union and human rights organisations.

· Urge the government to attend a meeting with SINTRAEMCALI and NOMADESC
Association, that has been convened for Tuesday 16th July 2002, in
Bogotá.

· Take IMMEDIATE PREVENTATIVE ACTION, against whatever attempt against
the physical and psychological well being of the leaders, activists,
spokes people and advisers of SINTRAEMCALI and their families, as well
as all social, popular and community leaders who are now at high risk.

· Make pronouncements to the United Nations, the Organisation of
American States, the Diplomatic Corps and the International Labour
Organisation so that there be guarantees for the human rights of
threatened people. Ask that they demand of the Colombian government and
competent authorities sufficient and necessary guarantees so that our
constitutional rights are respected, such as he right to life, security,
freedom of opinion, information, demonstration, trade unionism and
protest.

· Co-ordinate an international delegation composed of international
organisations to follow this situation. to make violations known, and to
be an observer over the Agreement signed between SINTRAEMCALI, the Cali
community and the Colombian Government.

· Solicit letters of support and protest from Members of Parliament and
above all, arrange a delegation of European, US and Canadian
parliamentarians to verify this grave situation.

· Demand of the Colombian government that it carries out an exhaustive
investigation in order to punish the material and intellectual authors
of the above mentioned incidents.

Finally, and in the light of existing evidence that members of state
security forces are following, filming, photographing and threatening
the workers, as was seen on 1st May, we make the Colombian State
responsible for whatever incident that follows against the well being of
the social, popular, human rights and trade union leaders.

Companeros, reciban un fraternal saludo, como era de esperarse la
situacion  se ha agudizado en los ultimos dias producto de las
malintencionadas publicaciones del periodico El Pais. Como les digimos
en el pasado mensaje hemos estado haciendo una serie de acciones de
caracter juridico y denuncia publica, ademas de la preparacion de una
reunin de alto nivel.  La Rueda de Prensa de ayer tuvo una buena
covertura y  surtio algun efecto.

Con la presente les estamos enviando la ultima accion urgente en donde
retomamos los senalamientos del periodico El Pais y se mencionan hechos
nuevos que tienden a ilegitimar e ilegalizar, la defensa que se ha hecho
de SINTRAEMCALI y la denucia tan fuerte  que se ha hecho por violacion a
los derechos humanos en la ciudad de Cali y en la region.

Incluimos  algunos antecedentes, que es pertinente mencionar, aun cuando
ya los habiamos denunciado en pasadas acciones, creemos que es
importante subrayarlos  en la medida que estos hechos hacen parte de una
politica sistematica, que persigue lograr la privatizacion de EMCALI
E.I.C.E. y el senalamiento de las organizaciones defensoras de los
derechos humanos.

Sin embargo no hay que desanimarse el respaldo nuevamente de la
comunidad ha sido importante y el proximo jueves lo van a manifestar
publicamente, como en "El sueno de las Escalinatas" de Jorge Zalamea,
nuevamente crece la audiencia.

Un abrazo grandote a todos y esperamos muchas acciones de respaldo.

IV.     ACCION URGENTE

HOMBRES SOSPECHOSOS PERSIGUEN A SINTRAEMCALI Y A LA ASOCIACIÓN NOMADESC

DURANTE LA  MISMA SEMANA LA ORGANIZACIÓN SINDICAL ES VICTIMA DE
SEÑALAMEINTOS POR PARTE DEL PERIODICO EL PAÍS

La Asociación para la Investigación y Acción Social NOMADESC y las
organizaciones abajo firmantes, pertenecientes a la Campaña Nacional e
Internacional contra la Corrupción, la Privatización y la Penalización
de la protesta social, denunciamos ante la comunidad Nacional e
Internacional, los graves hechos ocurridos durante la semana del 30 de
junio al 8 de julio. Acciones que se suman a la sistemática persecución,
señalamiento, amenaza, tortura sicológica y asesinatos que viene
sufriendo Sintraemcali, los lideres comunales de la ciudad  y sus
asesores, luego de los acuerdos firmados el  29 de enero del 2002, con
el gobierno colombiano, en los que se logro frenar la privatización de
las Empresas Municipales de Cali, EMCALI E.I.C.E.

Hechos:

[1.- Articulo del 30 de junio de 2002 El Pais,

accion de rectificacion de SINTRAEMCALI el 2 de julio ...]


La acción de rectificación [...] fue respondida en los siguientes
términos por parte de la Jefe del Departamento Jurídico,  del Periódico
"El País", CAROLINA ESCRUCERÍA C. "Cita usted la directiva número 07 del
12 de noviembre de 1999, expedida por la Presidencia de la República y
dirigida a los servidores públicos. Obviamente EL PAIS no tiene la
investidura de SERVIDOR PUBLICO, por lo cual no le es aplicable ese
mandato. Quizás usted pretenda que los concejales cumplan esa orden, por
lo cual le recomendamos dirigir a ellos su sesuda inquietud jurídica."

2.- El 4 de julio de 2002, aproximadamente a las 11 a.m. llegó a la
oficina del abogado Hermes Sánchez, un hombre entre 38 y 42 años, de
1,62 a 1,65 de estatura, tez blanca, contextura gruesa, pero atlética,
pelo corto y canoso con gafas, quien manifestó llamarse Eduardo y dijo
trabajar con  Sintraemcali, este hombre acudió con el supuesto fin de
presentar el trabajo que, según él, venía haciendo desde el sindicato.

Al entablar conversación con el abogado, este sujeto expresó: "que él
había estado en el M-19 y que si no se acordaba que habían estado
arriba", ante esta afirmación, el abogado le manifestó, que él desde
hace muchos años ha representado procesos sociales, que ha sido concejal
por el partido conservador y él había estado como representante de la
sociedad civil en el proceso  de paz con el M-19, que no recordaba nunca
haberlo visto. Insistiendo  que ya se conocían le pregunto al abogado
que él  en que proyecto estaba, si se acordaba que el era amigo de
Carlos el de la universidad que acababa de llegar de Europa.

Frente a este ultimo comentario es importante  anotar que la "Campaña
Nacional e Internacional de Derechos Humanos, contra la Privatización,
Corrupción y penalización de la Protesta Social", coordinada por la
Asociación Nomadesc, Sintraemcali, el Comité de solidaridad con presos
Políticos, Seccional Valle del Cauca y la CUT - Valle  entre otras
organizaciones sociales y sindicales  de la región, tuvo  como
representante en Europa al Fiscal de Sintraunicol Valle y miembro de la
Junta Nacional de la CUT, Carlos González,  gira  que duro  del 29 de
abril al 23 de junio del 2002 y en la que participo entre otros eventos
en la conferencia de la OIT, en Ginebra, Suiza.

El individuo insistió en que era muy importante que ellos se vincularan
con el trabajo de Sintraemcali y con la oficina de Derechos Humanos,
pues se estaban trabajando unos proyectos nuevos, que estaban dictando
charlas donde ellos se podían vincular, que también trabajaban con
desplazados. El abogado le manifestó que no estaba interesado en esos
temas que por ahora se estaba dedicando a unas demandas por corrupción
y asesorando la reforma legislativa, que lo que el le proponía no le
interesaba.

El hombre le manifestó que no tuviera miedo que si necesitaba salir del
país podía hablar con Berenice que ella lo sacaba del país, usted la
conoce ? el abogado expresó que la única Berenice que conocía era la del
Cuento de Edgar Alan Poé, entonces el tipo le contesto que no, que ella
era  de derechos humanos y que la podía conseguir en el tercer piso del
Sindicato o si no podía contactar  también a los abogados del Colectivo
José Alvear Restrepo. El abogado manifestó que él, no tenia ningún
interés de irse del país. El hombre expreso: " Mire hablando más claro
nosotros estamos trabajando es con la guerilla, nosotros traemos
guerrilleros heridos y los curamos hacemos todo en coordinación con
ellos". En ese momento el abogado lo interpeló y le manifestó que él no
tenia ningún interés de seguir hablando de esas cosas que no le
interesaba para nada ese tema y que su función era la asesoría jurídica.

El hombre seguía insistiendo en que lo podían vincular como asesor del
sindicato, decía cosas como por ejemplo si Policarpa Salavarrieta y José
Hilario López lo hicieron por que no lo podíamos hacer nosotros ahora.
El abogado le manifestó que no tenia más tiempo y el hombre se fue.

Resaltamos que  en Sintraemcali, Nomadesc o el Departamento de Derechos
humanos y se de la Campaña Nacional e Internacional de derechos humanos,
nadie conoce a este señor que dijo llamarse Eduardo, que no trabaja en
ninguna de sus oficinas. Igualmente nos extraña que este individuo halla
llegado a la oficina del abogado HERMES SÁNCHEZ, quien no ha asesorado
directamente a Sintraemcali, pero igualmente anotamos que  dos de sus
colegas con quienes comparte la oficina de abogados, han asesorado a
SINTRAEMCALI, en el  pasado  para presentar demandas muy puntuales
contra la corrupción que se ha presentado al interior de EMCALI,
E.I.C.E.

Antecedentes

[1.- El 1 de Mayo de 2002 infiltracion de dos agentes de inteligencia
militar y lideres sindicalistas golpeados. El caso de mayor gravedad fue
el de  JESÚS GONZÁLEZ, quien estuvo cinco días hospitalizado.

2. El 18 de abril de 2002, BERENICE CELEYTA y un estudiante salieron de
la sede de SINTRAEMCALI, seguidos y amenazados por un equipo de
asesinos.

3. El 22 de febrero de 2002, despues de una reunion en Bogota con unos
lideres de la Central de Trabajadores Británicos LUIS HERNÁNDEZ fue
seguido y escapo un atentado.]

SOLICITAMOS

Por lo anteriormente expuesto solicitamos a todos ustedes:


· Exigir del Periódico "El País", rectifique en primera pagina del
Periódico, las noticias que ha sacado y sea respetuoso de las
organizaciones sociales, populares, sindicales y de derechos humanos.

· Solicitar al alto gobierno acudir a la reunión que SINTRAEMCALI y La
Asociación Nomadesc esta convocando para el próximo Martes 16 de julio
de 2002, en la ciudad de Bogotá.

·  ACCION INMEDIATA DE PREVENCIÓN, en contra de cualquier  hecho que
atente contra la integridad Física y sicológica de los dirigentes,
activistas, voceros y asesores  de Sintraemcali y sus familiares, así
como de todos los  lideres, sociales, populares, comunitarios, que se
encuentran en alto riesgo.

· Pronunciarse ante la  Organización de Naciones Unidas, ONU, la
Organización de Estados Americanos, OEA, el Cuerpo Diplomático con sede
en Colombia y Organización Internacional del Trabajo, OIT, para que sean
garantes de los derechos humanos de las personas amenazadas y  soliciten
al gobierno colombiano Demandar del gobierno  colombiano y las
autoridades Competentes, garantías suficientes y necesarias para que se
respeten los derechos constitucionales, como el derecho a la vida,
seguridad, libertad de opinión, información, movilización,
sindicalización  y protesta.

· Coordinar una delegación internacional compuesta por organizaciones
internacionales que den seguimiento a esta situación y constaten las
denuncias  interpuestas y realice  una labor de veeduría frente a los
acuerdos firmados el 29 de enero entre Sintraemcali, la comunidad Caleña
y el Gobierno Colombiano.

· Solicitar cartas de apoyo y denuncia frente a esta situación a
miembros del parlamento, pero sobre todo, gestionar la presencia de una
comisión de parlamentarios europeos, Norteamericanos y canadienses para
que verifiquen esta grave situación.

· Exigir al gobierno Colombiano se desarrolle una investigación
exhaustiva para dar castigo a los responsables materiales e
intelectuales de los hechos aquí denunciados.


Por último y ante la evidencia que existen miembros de la fuerza pública
efectuando seguimiento, fotografiando, filmando y amenazando a los
trabajadores, como se constatado el 1 de Mayo pasado, hacemos
responsables al Estado Colombiano de cualquier hecho que atente contra
la integridad de los   dirigentes sociales, sindicales, populares y de
derechos humanos.
