Raid on CUT Office in Cali;
Wave of Uribe-Paramilitary Terror

According to trade union leader Miguel Caro, agents of the Attorney General's office and Department of Administrative Security (DAS) occupied the headquarters of the CUT in Cali on Friday [10th January]. Caro, who indicated that the agents presented a judicial order, rejected the process indicating that the CUT does not harbour delinquents and that trade union freedoms had been violated.

"We reject this attack on trade union freedom, we consider that it is an arbitrary act becuase the security organisations have nothing to go and look for in a trade union headquarters, given that they will not find delincuents or anybody else attempting to break the law in any way", Caro declared to journalists.

The Attorney General and DAS did not make an immediate pronouncemnt in reposnse to the CUT's protests.

Carlos Lozano the director of Voz, the weekly newspaper of the Colombian Communist Party (PCC), said that the raid is a "provocation" against the workers and social movement, and pointed out that it coincided with the CUT's campaign to invite voters to abstain in the government's forthcomimg referendum. "This is a serious incident; the CUT is the country's principal trade union centre, a veryt respectable organisation to which thousands of workers are affiliated, and the raid is an open attack on the popular, social and trade union movement in Colombia" Lozano argued. He added that "this event has occurred on the same day that the Minister of Interior, Fernando Londoño, openly incited moves to block democratic access the the referendum abstention campaign, which the amongst other things is headed by the CUT".

The local press indicate that the raid on the CUT's regional headquarters would be related to the recent capture of a trade unionist and a lawyer acciused by the authorities of having links with the Revolutionary Armed Forces of Colombia (FARC). According to these same sources, agents of the Attorney General and the DAS are inspecting the filed and other documents in the union offices.

57 ASSASSINATIONS IN THE FIRST 10 DAYS OF 2003 IN CUCUTA

In just the ten first days of 2003 in Cucuta 57 violent killings by paramilitaries have been registered. A group of paramilitaries carrying long range and automatic weapons wreaked terror on the night of 9 January and the morning of 10 January, with massacres in the poor districts of Camilo Daza and Antonia Santos resulting in eight deaths. There was another killing during a paramilitary incursion into the district of Dona Nidia.

The number of violent deaths in the past year, overwhelming attributed to paramilitaries and committed with firearms, in Cucuta, Los Patios and Villa del Rosaria, came to 1,429 (Cucuta 1,236, Los Patios 111 and Villa del Rosario 92) with most of the victims displaced from the countryside by these same paramilitaries. Last December there were 84 paramilitary killings in Cucuta and in November, the month in which the AUC leaders agreed to an end to hostilities in the run up to negotiations with the government due to start next week, there were 116 killings by the death squads.

The night of 9 January 2003 turned into one of the most violent to date in the current year. Between 10:30pm and 11:00pm eight murders were committed by paramilitaries in the districts of Antonia Santos and Camilo Daza. A group of paramilitaries carrying automatic firearms arrived at Antonia Santos and immobilised two security guards, Freddy Ortiz Fuentes and Jeider Contreras Prada. They made them get down on the ground face down and then shot them. Contreras, 18 years old, died on the spot. This was at 10:30 pm. Fuentes was hit by the bullets and pretended to be dead. This saved his life. The paramilitaries thought they had completed their task and went away to continue delivering their deadly message and search for more victims.

The paramilitaries went to an area known as Los Olivos and killed a young boy of 17 years, who had been working for a month and a half and a security guard, and also killed Oscar Pabon Miranda, 22 years, who was the first boy's brother in law.

In the suburbs of Camilo Daza and Crispin Duran, at 11:00pm, the paramilitaries attacked Rafael Ricardo Vanegas Mejia, 18 years. He was shot several times, once in the head. They also shot Jose Adrian Rodriguez Sanchez in the head. Maria Rubiela Poveda Sanchez, 39 years, was shot in the head. She was a civic leader in the area and worked for the community. She was also pregnant. Her son, Raul Ronderas Poveda, 18 years, was shot three times. Both were killed at their home. Olider Miguel Zafra Serpa, 23 years, was the final victim that night in this district. The paramilitaries came to his home and dragged him out in front of his partner and children. They made him walk a few steps and when he turned round to come back to the house, they shot him dead. He had four bullet wounds. Zafra Serpa leave a widow and four young children. Walls in this district were daubed with AUC paramilitary slogans.

At 3:00 am the next morning, a group of paramiitaries bearing long-range and automatic weapons entered the suburb of Dona Nidia, in the west of Cucuta. At 3:15 they arrived at the house of labourer Reinaldo Camacho Gil, 40 years.They banged on the door and asked him to open it, identifying themselves as representatives of a security organisation. They then proceeded to drag him out of his home and killed him in the street. Around 20 paramilitaries came to Dona Nidia, all carrying firearms.

URIBE VELEZ DEFENDS THE PARAS

On the same day of the assassinations, the president defended his decision to initiate negotiations with the paramilitaries. Answering a question about the formation of an Exploratory Commission for the illegal self-defence groups and not for the guerilla groups, the president asserted, according to CNE, the presidential news agency: "The only group that has accepted an end to hostilities is that of the autodefensas."

And this is the presidential condition and explanation to permit peace negotiations inside the country with the "paras" and not abroad through the UN, which is Uribe's condition for starting up dialogue with the ELN and the FARC.

URGENT CALL FOR SOLIDARITY - RAID ON THE HOME OF FENSUAGRO LEADERS AND ARBITRARY DETENTIONS

On the night of Wednesday 8 January, husband and wife POLICARPO CAMACHO and GLORIA HOLGUEN, leaders of the agricultural workers' union (FENSUAGRO) in the municipality of Calarco, were subjected to the search of their home, in the urban area of this municipality. Copies of the weekly newspaper, Voz, trade union pamphlets and other documents related to the trade union and political activities of these two democratic individuals conscious of the need to participate in the struggles of the people for peace with social justice, were the only trophies found by the sleuths of the Public Prosecutor representing the Manzinales region, under whose order the two comrades, along with four friends with whom they were socialising at the time of the raid, which lasted several hours, remain in detention at the discretion of the Public Prosecutor of Armenia.

In the name of "democratic security" there is a witch hunt being carried out whereby fundamental rights including the right to freedom to express and disseminate your thoughts and opinions, to family intimacy, the freedom to carry out trade union activities, etc. are being violated. Therefore we ask our brother organisations to add their voice of solidarity and demand of the state bodies concerned respect for people's human rights and freedom for trade unionists to carry out their activities.

We demand the immediate release of the comrades detained in Calarco (Quindio).

DISAPPEARED - TREASURER OF THE ARAUCA CAMPESINO ASSOCIATION, SARAVENA

On 7 January, at 5 in the morning, DENYS ALBERTO MONSALVE GARZON, 33 years of age and treasurer of the Arauca Campesino Association (ACA), Saravena branch, was disappeared when he was about to take a public service taxi from Saravena to Pueblo Nuevo, Tame municipality.

He had been a victim for several months of accusations on the part of the Saravena Police who had harassed him and detained him on a number of occasions on suspicion of collaborating with the guerillas and being the author of a number of actions against the public forces, charges which have no other foundation than the suspicions of the police and which made him instantly into a target of the paramilitary groups which operate with the connivance and acquiescence of the public forces.

On several occasions, members of this same police institution, upon having to release him after arbitrarily detaining him have said to him "take care of yourself" an expression which is interpreted as a threat. For this reason, the Executive Committee of ACA took the decision to move him to Pueblo Nuevo to make sure he did not fall into the hands of the police which do not enjoy the people's confidence as last year some of its members participated in arbitrary detentions, torture and assassinations, cases which the Public Prosecutor investigated and sanctioned.

We demand that:

• the commander in chief of the Armed Forces orders the army to start an immediate search for DENYS ALBERTO MONSALVE GARZON who was disappeared in Saravena, one of the most militarised municipalities in the country and declared a zone of rehabilitation and consolidation
• the Public Defender activates a commission to search for disappeared people
• the Public Prosecutor carries out the appropriate investigations in order to determine the whereabouts of DENYS ALBERTO MONSALVE and that he is found safe and sound
• the General Attorney investigates the conduct of members of the national police force denounced in this urgent action and their constant harassment of Mr Monsalve Garzon
• the public forces be made entirely responsible for what happens to DENYS ABLERTO MONSALVE GARZON given that Saravena is completely controlled by the public forces as it is a zone of rehabilitation and consolidation.
• the Office of the United Nations High Commissioner for Human Rights intermediates before the Colombian authorities in order to succeed in finding Mr Monsalve, member of the Arauca Campesino Association, in a perfect physical state.

Denuncian allanamiento de las oficinas de la Central Unitaria de Trabajadores (CUT) de Cali

Según Miguel Caro, directivo sindical, este viernes agentes de la Fiscalía y del Departamento Administrativo de Seguridad (DAS) ocuparon la sede. Caro, quien indicó que los agentes presentaron una orden judicial, rechazó el procedimiento indicando que allí no hay delincuentes y que se está violando la libertad sindical.

"Rechazamos este atentado contra la libertad sindical, consideramos que es un acto arbitrario porque los organismos de seguridad no tienen nada que ir a buscar en las sedes sindicales, por cuanto allí no se refugian delincuentes ni gente que atente contra la ley de ninguna manera", declaró Caro a periodistas. La Fiscalía y el DAS no se pronunciaron en lo inmediato sobre las denuncias de la CUT.

El director del semanario Voz -el órgano informativo del Partido Comunista Colombiano (PCC)-, Carlos Lozano, dijo que el allanamiento es una "provocación" al movimiento obrero y social, y señaló que coincide con una campaña emprendida por la CUT para invitar a los ciudadanos a abstenerse de votar un referendo impulsado por el Gobierno.

"Es un hecho bastante grave; la CUT es la principal central sindical del país, una organización muy respetable que aglutina a miles de trabajadores, por lo que es una provocación abierta contra el movimiento sindical, social y popular en Colombia", sostuvo Lozano. Agregó que "este hecho coincide cuando en el día de ayer el señor ministro del Interior, Fernando Londoño, hizo una abierta incitación a cerrarle las posibilidades de acceso democrático a la campaña de abstención por el referendo, que entre otras cosas encabeza la CUT".

Medios de prensa locales indicaron que el allanamiento a la sede de la CUT estaría relacionado con la reciente captura de una sindicalista y un abogado acusados por las autoridades de tener vínculos con las Fuerzas Armadas Revolucionarias de Colombia (Farc). Según esas mismas versiones, los agentes de la Fiscalía y el DAS inspeccionan los archivos y otros documentos de la central obrera.

57 ASESINATOS EN SOLO 10 DIAS DEL 2003 EN CUCUTA

En apenas los 10 primeros días que van corrido del año 2003, en Cúcuta se habían registrado hasta ayer 57 muertes violentas. Un grupo de paramilitares portando armas de largo alcance y automáticas sembró el terror la noche del 9 y el amanecer del 10. Hubo masacres en los barrios pobres de Camilo Daza y Antonia Santos con un saldo de ocho muertos. Hubo otro asesinado en una incursión paramilitar en el barrio Doña Nidia.

El ano pasado, el numero de muertes violentas, en su inmensa mayoria atribuidos a los paramilitares y cometidos con armas de fuego, en Cúcuta, Los Patios y Villa del Rosario, fueron 1.429 (Cúcuta, 1.236; Los Patios - 111; Villa del Rosario - 92) con muchas de las victimas desplazadas del campo por los mismos paramilitares.

En diciembre pasado se registraron 84 asesinatos por paramilitares en Cúcuta y en noviembre, el mes que vio declarado un cese de hostilidades por los lideres paramilitares en anticipacion de sus negociaciones con el gobierno nacional la semana que viene, hubo 116 asesinatos por los escuadrones de muerto.

La noche del 9 de enero, se convirtió en la más violenta de lo que ha trascurrido del 2003. Entre las 10:30 y las 11:00, cometieron ocho homicidios, en los barrios Antonia Santos y Camilo Daza. A Antonia Santos llegaron un grupo de paramiitares con armas de fuego automáticas e inmovilizaron a los vigilantes Freddy Ortiz Fuentes y Jeider Contreras Prada. A los serenos los obligaron a tenderse en el piso, boca abajo, y luego les dispararon. Contreras, de 18 años murió en el lugar de la agresión. El hecho sucedió a las 10:30 de la noche. Fuentes recibió impactos de bala, y fingió estar muerto. Eso le salvó la vida. Los agresores consideraron que habían cumplido su cometido y se fueron a otro lugar, con su trágico mensaje.

El grupo se fue a otro lugar en busca de más víctimas. En el sector conocido como Los Olivos, le dieron muerte a un menor de 17 años, quien hacia mes y medio trabajaba como vigilante, y a Oscar Pabón Miranda, de 22 años, cuñado del anterior. Utilizaron armas de fuego automáticas.

En los barrios Camilo Daza y Crispín Duran a las 11:00 de la noche atacaron a Rafael Ricardo Vanegas Mejía, de 18 años. Recibió varios impactos de bala, algunos de ellos en la cabeza. A José Adrián Rodríguez Sánchez le propinaron un balazo en la cabeza. María Rubiela Poveda Sánchez, de 39 años, recibió un balazo en la cabeza. Era dirigente cívico en el sector, y colaboraba con la comunidad. Ademas estaba embarazada. Raúl Ronderos Poveda, de 18 años, hijo de la anterior. Recibió tres impactos de bala. A los dos los mataron en su residencia. Olider Miguel Zafra Serpa, 23 años, fue la última víctima de la noche en ese sector. A su vivienda llegaron los paramilitares y lo sacaron, ante el asombro de su compañera y sus hijos. Lo obligaron a caminar unos pasos y a la vuelta de la casa le dieron muerte a bala. Presentaba cuatro heridas. Zafra Serpa, deja una viuda y cuatro hijos pequeños. Las paredes del barrio fueron pintadas de graffitis con consignas de la "AUC".

A las 3:00 de la mañana, un grupo de paramilitares portando armas de largo alcance y automáticas irrumpió en el barrio Doña Nidia, al occidente de Cúcuta. A las 3:15 llegaron a la casa del obrero Reinaldo Camacho Gil, de 40 años. Golpearon en la puerta y le pidieron que abriera, identificándose como representantes de un organismo de seguridad. Procedieron a sacar a Camacho Gil, y en la calle le dieron muerte. Los paramilitares que llegaron a Doña Nidia, eran por lo menos 20 hombres, todos con arma de fuego.

URGENTE LLAMADA A LA SOLIDARIDAD - ALLANADA VIVIENDA DE LIDERES DE FENSUAGRO EN CALARCO

La noche del miercoles 8 de Enero, los esposos POLICARPO CAMACHO y GLORIA HOLGUEN, dirigentes del Sindicato agricola (FENSUAGRO) en el municipio de Calarco, sufrieron el cateo de su habitacion ubicada en el area urbana del mismo. Ejemplares del semanario VOZ, boletines sindicales y otros escritos relacionados con su actividad sindical y politica, como personas democratas conscientes de la necesidad de participar en la organizacion y en las luchas del pueblo por la paz con justicia social, fueron el unico trofeo encontrado por los sabuesos de la Fiscalia, bajo cuya orden, regional de Manizales, quedaron detenidos en las dependencias de la Fiscalia de Armenia el companero y la companera, junto a otros cuatro amigos con quienes departian a la hora del allanamiento, operativo que duro varias horas.

En nombre de la "seguridad democratica " se vienen practicando las caceria de brujas, mediante las cuales se violan derechos fundamentales, entre otros la libertad de expresar y difundir los pensamientos y opiniones, la intimidad familiar, la libertad de accion sindical, etc. En consecuencia, solicitamos a las organizaciones hermanas hacer llegar su voz solidaria ante las correspondientes entidades estatales, reclamando respeto a los derechos de las personas y la libertad de los sindicalistas.

Exigimos la inmediata libertad de los companeros(as) detenidos en Calarco (Quindio).

DESAPARECIDO - TESORERO DE LA ASOCIACION CAMPESINA DE ARAUCA SECCIONAL SARAVENA

El día 7 de enero, a las 5 de la mañana fue desaparecido Denys Alberto Monsalve Garzón de 33 años de edad, fiscal de la Asociación Campesina de Arauca -ACA- seccional Saravena, cuando se disponía a tomar un taxi de servicio público desde Saravena hacia la inspección de Pueblo Nuevo, municipio de Tame.

EL venía siendo víctima, desde hace varios meses, de señalamientos por parte de miembros de la Policía de Saravena, quienes lo han hostigado y detenido en varias ocasiones y llevado a la Estación de Policía por ser sospechoso de colaborar con la guerilla y por "ser el autor de varios hechos en contra de la fuerza pública", cargos que no han tenido más fundamento que la "sospecha" de la policía y que lo convierte de inmediato en blanco de ataque por parte de los grupos paramilitares que actúan en connivencia y aquiescencia con la fuerza pública.

En varias ocasiones, miembros de esa misma institución policial, al tener que dejarlo libre después de haberlo detenido arbitrariamente le han dicho "cuídese", expresión que es interpretada como una amenaza. Por esta razón, la Junta Directiva de ACA tomó la decisión de trasladarlo hacia Pueblo Nuevo para evitar que cayera en manos de la policía que no cuenta con la confianza de la población civil ya que el año pasado algunos de sus miembros participaron en detenciones arbitrarias, torturas y asesinatos, casos que investigó y sancionó la Fiscalía General de la Nación.

Exigimos que:

• el comandante y jefe de las Fuerzas Armadas, ordene a éstas la búsqueda inmediata de DENYS ALBERTO MONSALVE GARZÓN, quien fue desaparecido en Saravena, uno de los municipios más militarizados del país y declarado como zona de rehabilitación y consolidación
• la Defensoría Nacional del Pueblo, active la Comisión de Búsqueda de personas Desaparecidas
• la Fiscalía General de la Nación, realice las investigaciones correspondientes que lleven a determinar el paradero y la ubicación sano y salvo de DENYS ALBERTO MONSALVE
• la Procuraduría General de la Nación, investigue las conductas de los miembros de la Policía Nacional denunciados en el presente escrito, en los que se hostigó de manera permanente al señor Monsalve Garzón
• responsabilice a la Fuerza Pública por lo que le pueda ocurrir a Denys dado que Saravena esta completamente controlada por la fuerza pública como zona de Rehabilitación y Consolidación
• la Oficina del Alto Comisionado de Naciones Unidas para los Derechos Humanos, intermedie ante las autoridades colombianas para lograr la aparición en perfectas condiciones del señor MONSALVE, miembro de la Asociación Campesina de Arauca.
