Urgent Action: Death Threats as Sintraemcali occupy to block Uribe Privatization

THE GOVERNMENT IS RESPONSIBLE FOR PRIVATISING EMCALI, ALL OF US HAVE THE RIGHT TO DEFEND PUBLIC SERVICES

"If you keep fucking around we are going to kill you all".

Two days before the anniversary of the signing of the Agreement on 29th January 2002, in a rash action the National Government, the Superintendent of Public Services Eve Maria Uribe issued Resolution 141 dated 23rd January which resolves to:

"Modify the administration of EMCALI EICE ESP and take possession of it in order to liquidate it and, in consequence, from the time of this resolution on to carry out the necessary actions to initiate the liquidation process".

This resolution is an assault on constitutional and legal norms. What is most serious is that it goes against the Agreement signed by the Colombian State with the workers of EMCALI EICE and the caleña community [people of Cali].

It is evident that the privatisation of the corporation follows the policy of President Uribe Velez as laid out in his proposal for a "Communitarian State".

Through raising shares in the so-called Social Capitalisation Fund the Superintendent and President Uribe are attempting to hand over the corporation to creditors (multinationals that have historically had ample return from EMCALI).

On learning of the resolution, the workers of EMCALI EICE gathered in their different work places and in the Central Administrative (CAM) Tower, to demand that the National Government waives this resolution and maintains the Agreement of 29th January 2002, which promised not to liquidate or privatise EMCALI, not to increase the price of public services, to renegotiate the debt with the Multilateral Bank, to assume the cost of the Waste Water Treatment Plant and other points.

However the state security forces are now surrounding and harassing the groups of workers. They are even threatening the workers at Colon Plant with death, where lieutenant Bolívar, police identification number No. 593, said, "If you keep fucking around we are going to kill you all".

It looks as though the resolution could be null and void given that the central authorities intervention in the management of EMCALI corporation was granted by a Presidential order, who is now formally in charge and takes precedence over a resolution by the Superintendent of Public Services.

It is important to remind the national and international community that there have been several attempts to privatise EMCALI EICE, the most recent occurred on 24th December 2001 during the Pastrana Government. Before that it was in June 1996 that the government of Presidente Samper, working under the directions of the International Monetary Fund, the World Bank and the World Trade Organisation amongst other multilateral organisations, adopted a clear policy of privatisation.

It is no coincidence that Presidente Uribe Velez, national leader who should adopt national policies, is so interested in deciding the future EMCALI EICE. We remember that during the election campaign vice presidencial candidate Francisco Santos cheekily announced the privatisation of EMCALI. On 9th August 2003, just two days after taking power, Uribe Velez travelled to Cali to show his intention of carrying out the privatisation through a proposed "Shareholder Company".

The workers trade union demands that the national government fulfils the commitment signed in the Agreement of 29th January 2002, and in consequence repeals Resolution 141 of 23rd January 2003.

We call on the national and international community to close ranks in defence of EMCALI E.I.C.E. and hence the Public Sector. The "social equity" of the Uribe Government cannot be allowed to bring chaos to the users of public services, sack workers, threaten them and harass them. That is why we call on the formation of a common front in defence of our rights.

LIQUIDAN A EMCALI E.I.C.E.

LA PRIVATIZACION DE EMCALI UNA RESPONSABILIDAD DEL ESTADO COLOMBIANO, LA DEFENSA DE LO PUBLICO UN DERECHO DE TODOS.

Dos días antes de cumplirse un año de la firma de los acuerdos del 29 de enero de 2002, en una acción temeraria por parte del Gobierno Nacional, la Superintendente de servicios públicos EVA MARIA URIBE, mediante resolución 141 del 23 de enero de 2003, Resuelve: "Modificase la modalidad de la toma de posesión para administrar de EMCALI EICE ESP, por toma de posesión con fines liquidatorios y en consecuencia, a partir de la presente resolución se procederá a realizar los actos necesarios para iniciar el proceso liquidatorio".

Esta resolución atenta contra normas constitucionales y legales y lo que es más grave va en contra de los acuerdos firmados por el Estado Colombiano con los trabajadores de EMCALI E.I.C.E y la comunidad caleña. Es evidente que la privatización de la empresa, responde a una política del presidente URIBE VELEZ, enmarcada dentro de su propuesta de Estado Comunitario.

La superintendencia y el Presidente Uribe pretenden con esta resolución entregar la empresa a los acreedores ( Multinacioles las cuales se han beneficiado históricamente de los recursos de la Empresa) por medio de acciones dentro del denominado Fondo de Capitalización Social.

Los trabajadores de EMCALI E.I.C.E, al conocer la decisión del Gobierno se concentraron en las diferentes Plantas de Trabajo y en el Centro Administrativo Municipal CAM, para exigir del Gobierno Nacional desista de esta resolución y mantenga el acuerdo del 29 de enero de 2002, en donde se comprometió a no liquidar ni privatizar EMCALI, no aumentar las tarifas de Servicios Públicos, renegociar la deuda con la Banca Multilateral, asumir el costo de la Planta de Tratamiento de Aguas residuales, entre otros puntos.

Sin embargo la fuerza publica ha rodeado y hostigado los sitios de concentración de los trabajadores llegando al extremo de amenazar de muerte a los trabajadores de la Planta de Colon, en donde el subteniente Bolívar, placas de identificación policial No. 593 expreso "Si siguen Jodiendo los vamos a matar a todos"

Es de anotar que esta resolución tiene visos de nulidad ya que la intervención de la empresa se dio mediante una resolución efectuada por la Presidencia de la Republica y es en cabeza del presidente y no de la Superintendente de Servicios Públicos.

Es Importante recordar, a la comunidad nacional e internacional que han sido varios los intentos de privatización de EMCALI EICE, los más recientes se dieron el 24 de diciembre de 2001 durante el Gobierno del Presidente Pastrana y Junio de 1996 en el gobierno del Presidente Samper y que ello corresponde a directrices del Fondo Monetario Internacional, La Banca Mundial, la Organización Mundial del Comercio entre otros organismos multilaterales y a una clara política de Estado.

No es coincidencial que el Presidente Uribe Velez, mandatario nacional, el cual debe adoptar políticas Nacionales, este tan interesado en direccionar el futuro de EMCALI EICE. Recordemos que durante la campaña presidencial el Vicepresidente Francisco Santos de manera descarada anuncio la Privatización de la Empresa y el y el 9 de agosto de 2002, dos días después de su posesión Uribe Velez, viajo a la ciudad de Cali y manifestó su intención de privatizar la empresa mediante la propuesta de "Sociedad por Acciones".

El sindicato de trabajadores exige al gobierno nacional cumplir con los acuerdos firmados el 29 de enero de 2002y en consecuencia derogar la resolución 141 del 23 de enero de 2003.

Llamamos a la comunidad nacional e internacional a cerrar filas en torno a la defensa de EMCALI EICE y por ende del Sector Publico, la "Equidad social" del Gobierno de Uribe no puede ser llevar al caos a los Usuarios de los Servicios públicos, despedir trabajadores, amenazarlos y hostigarlos por ello llamamos a constituir un Frente común en defensa de nuestros derechos.
