Sintraemcali: 5,000 Rally broken up by Teargas and Explosion

The Human Rights Association NOMADESC, the Trade Union of Cali Municipal Corporation Workers SINTRAEMCALI, and the other members of the "National and International Campaign Against Privatisation, Corruption and the Criminalisation of Social Protest" all denounce to national and international opinion the serious events that occurred in the midst of the Citizens' Demonstration on 29th January 2003. The rally was held in the square below the CAM Tower to protest against Resolution 141 of the Superintendent of Public Services which attempts to liquidate EMCALI EICE [EICE denotes legal status as a state corporation - Translators note] and to demand that the National Government implements the Agreement of 29th January 2002.

The Events:

1. More than five thousand people assembled in the square in front of the Municipal Administration Centre (CAM Tower) to peacefully demand that the National Government, headed by president ALVARO URIBE VELEZ, and the Superintendent of Public Services EVAMARIA URIBE TOBON, revoke the resolution to liquidate and privatise EMCALI. Just as the cultural part of the programme was about to begin, before speeches from Citizen's Watch representative Dr. ALICIA OSORIO, from SINTRAEMCALI President LUIS HERNÁNDEZ, and by Congressman Dr. ALEXANDER LOPEZ, two explosives were let off.
    
2. In the ensuing commotion the following were beaten up and detained: JUAN CARLOS MURILLO, a worker at EMCALI's Energy Plant; ALEJANDRO QUIBANO a student at the SINTRAEMCALI Institute in Barrio Poblado II district and JUAN MANUEL SÁNCHEZ FORERO, a worker in the Copying Section of SINTRAEMCALI, who had just arrived at the CAM plaza bringing materials for a display to show at the event.
    
3. A leader from Poblado II district called out to BERENICE CELEYTA, president of NOMADESC, who had been presented to the rally as the co-ordinator of the Campaign Against Privatisation, leading actions in defence of the EMCALI workers. She descended from the platform accompanied by a member of Peace Brigades International. They went to the police holding post where the detainees were being held, a Centre of Immediate Attention (CAI) at the back of the square. Inside the CAI, of the three people attacked and arrested by the police only young JUAN CARLOS SÁNCHEZ could be found. Several students on SINTRAEMCALI's courses and the director of the Institute WILMAR LOZANO were already at the holding station demanding the release of their comrades. BERENICE asked COLONEL SUÁREZ to explain the reason for the arrests, and the whereabouts of the other two arrested people. At that point WILSON ARIAS, a member of the CUT National Executive and a leader of the SINDESENA union [Union of further education teachers and workers] also arrived and demanded why young people were being arrested. He too was assaulted. The youths from the Institute chanted "Let them go! Let them go!". Under the orders of COLONEL SUÁREZ the police launched their sticks on the students, workers and members of the community who were gathering outside the police station.
    
4. Then explosives were thrown down from the CAM Tower, from directly over where the students were. According to participants at the scene "it was the police themselves who threw down explosive grenades and tear gas canisters from the third, fourth and eleventh floors that communicate with the Mayor's building". [The two towers are linked by three aerial corridors].
    
5. As a result ALVARO GOMEZ was injured. He works in the Reading and Distribution Section of the C.A.M. and is a community leader. Congress Representative ALEXANDER LOPEZ was informed of the events and when he came towards the CAI holding post, two grenades fell near to him, by good fortune he was not wounded.
    
6. Simultaneously the police shot tear gas into the square, making everybody disperse. This was done without gauging the damage that they might cause to the children, pregnant women and elderly who were in the rally, many of them families of EMCALI workers.
    
7. Afterwards some members of the community showed another SINTRAEMCALI leader FABIO BEJARANO and BERENICE where the detainees were being held, in a police wagon surrounded by police and army that was going to taken them off to a police station.
    
   At that point an individual came up to BERENICE and said several things about the events, trying to make the police responsible. BERENICE did not reply and then he said, "Don't worry. I'm a sociology student at Cauca Valley University". It is important to note that this same individual had followed BERENICE when she had visited Cauca Valley University to attend a forum on Forced Displacement.
    
8. At about 7:30 p.m, when there were very few people still around the square and in the CAM tower, COLONEL SUÁREZ came out. The president of NOMADESC gave him a public denunciation, she protested the attitude of the Security Forces and stated that she was going to make public all the irregularities that had occurred. According to community leaders who were present, the Colonel spoke in a threatening tone to a man in civilian dress who was with him all the time: "Target, Target, Target" he said and pointed to BERENICE. The man in civilian clothes was the same one who had ordered a policeman to film all the detainees and everyone who had been demanding their release.
    
   At the same time CAMILO TORRES who is the Supervisor of the CAM Tower, was summonsed by some police agents. Some wives had gone there [to escape the attack?]. Then they left and CAMILO was put under the orders of COLONEL SUAREZ who drove him to FRAY DAMIÁN police station. Several workers, lawyers and human rights defenders from NOMADESC and the Solidarity Committee with Political Prisoners went there.
    
   Three of the detainees were releases at 9:30 p.m. after several interventions by representative ALEXANDER LOPEZ.

Background

1. The CAM square was completely cordoned off, in the early morning hours of today, 29th January. There was no point of its four entrances where access could be gained without police permission.
2. At approximately 9:00 a.m. officials arrived to set up the stage in the CAM along with two members of the Light of the Moon Theatre Collective. The police cordoning off the square stopped them. According to the police commander, Colonel OSCAR NARANJO TRUJILLO, the event did not have permission, despite the fact that Mayor JHON MARO RODRÍGUEZ had authorised it.
3. At 10:00 a.m when SINTRAEMCALI asked NOMADESC to verify the permission, Colonel YÁNEZ told BERENICE CELEYTA that he had just received confirmation from the Mayor. BERENICE pointed out that the police had prevented entrance of equipment for the rally, such as bricks that the theatre collective needed for their show "From the Land" depicting forced displacement. The bricks are used to simulate the city where the displaced people end up. At first this police official said no, but then he acceded to consult with Major ZÚÑIGA, with whom BERENICE asked to speak. The Major said no, and he hoped that the theatre piece was not a subversive work insighting the community to disorder, because if it was it would be prohibited. The human rights defender argued that if the Major did this he would be contravening a number of rights, such as the right to use public spaces, freedom of expression, the right to recreation, culture and protest amongst others.

We request:

An impartial investigation of the described events and if there is the basis that members of the security forces involved in these irregularities be charged.

That the Colombian government revoke Resolution 141 liquidating EMCALI EICE and that the Agreemnt of 29th January 2002 is implemented.

Berenice Celeyta visited Britain in March 2002, when she addressed the TUC General Council on behalf of SINTRAEMCALI and addressed public meetings of supporters around the country. She was a guest at the Euro Social Forum inItaly in November . It is evident that she is in special danger, along with all our comrades in SINTRAEMCALI.

Yesterday we picketed the Colombia Embassy and delivered a letter of protest. UNISON and the TUC has similarly sent messages of support to SINTRAEMCALI and letters of concern via the Embassy to the Colombian government. La Asociación de Derechos Humanos Nomadesc, El Sindicato de Trabajadores de las Empresas Municipales de Cali, Sintraemcali, y demás miembros de la "Campaña Nacional e Internacional contra la Privatización, la Corrupción y la Penalización de la Protesta Social", denuncian ante la comunidad nacional e internacional los graves hechos ocurridos en medio de la Concentración Ciudadana, efectuada en la plazoleta del C.A.M. para denunciar la resolución 141 con la cual la Superintendencia de Servicios Públicos, pretende liquidar EMCALI EICE ESP y exigir del Gobierno Nacional cumplimiento a los acuerdos del 29 de enero de 2002.

Los Hechos:

1. Cuando más de cinco mil personas se encontraban en la plazoleta del Centro Administrativo Municipal C.A.M. para exigir pacíficamente al Gobierno Nacional, al presidente ALVARO URIBE VELEZ y la Súper Intendente de Servicios Públicos, EVAMARIA URIBE TOBON, sea derogada la resolución por la cual se liquida y privatiza EMCALI, y cuando iba a iniciar el acto cultural, luego de las intervenciones de la Veedora ciudadana Dra. ALICIA OSORIO, LUIS HERNÁNDEZ, Presidente de Sintraemcali y el Dr. ALEXANDER LOPEZ, Representante a la Cámara, sonaron dos artefactos explosivos.
    
2. Acto seguido fueron detenidos y golpeados JUAN CARLOS MURILLO, Trabajador de la Planta de Energía, ALEJANDRO QUIBANO estudiante del Instituto Sintraemcali, en del Barrio Poblado II y JUAN MANUEL SÁNCHEZ Forero, Trabajador de la Sección de Copiados de Sintraemcali, quien había llegado al CAM a llevar un trabajo de impresión para el evento.
    
3. Inmediatamente un líder del poblado II aviso a la presidenta de la Asociación Nomadesc BERENICE CELEYTA, quien se encontraba presentando el evento, como coordinadora de la Campaña contra la privatización, que viene liderando acciones de defensa de los trabajadores de EMCALI y ella bajo de la tarima en compañía de Brigadas Internacionales de Paz, hacia el lugar donde se encontraban los detenidos, C.A.I. de la Policía, ubicado en la parte posterior de la plazoleta donde continuaba el evento. En el CAI, de los tres detenidos solo se encontraba el joven JUAN CARLOS SÁNCHEZ, quien había sido agredido por la policía y varios estudiantes del Instituto de Bachillerato de Sintraemcali en compañía del director del Instituto WILMAR LOZANO, exigiendo la liberación de sus compañeros, al llegar la defensora de derechos humanos solicito al CORONEL SUÁREZ, explicar la razón de la detención y solicitó información de donde se encontraban los otros detenidos el coronel la agredió verbalmente. En esos momentos llego WILSON ARIAS, ejecutivo de la CUT Nacional y directivo sindical de Sindesena y solicito igualmente la razón de la detención de los Jóvenes, quien igualmente fue agredido. Acto seguido los Jóvenes del instituto arengaban "que los suelten que los suelten" los agentes de policía por orden del Coronel Suárez, emprendieron a bolillo contra los estudiantes, trabajadores y miembros de la comunidad que se encontraban fuera.
    
4. Al tiempo que desde la torre lanzaban artefactos explosivos, justo debajo de donde se encontraban los estudiantes. Según versiones de los participantes "la misma policía lanzo papas explosivas y granadas de gas lacrimógeno desde el tercero, cuarto y once pisos que comunican con la Alcaldía".
    
5. Resultando herido ALVARO GOMEZ de la Sección de Lectura y Reparto C.A.M. y un líder del poblado. Igualmente el Representante a la Cámara ALEXANDER LOPEZ fue notificado de los hechos y cuando se disponía a acercarse al CAI, dos papas cayeron muy cerca por donde se desplazaba, por fortuna sin causarle ninguna lesión.
    
6. Simultáneamente la policía disparaba gases lacrimógenos, en la plazoleta lo que ocasiono que todo el mundo se dispersara. Sin medir las consecuencias del daño que pudieron causar a niños, mujeres embarazadas y ancianos, muchos de ellos familiares de los trabajadores, que se encontraban en la concentración.
    
7. Posteriormente, algunos miembros de la comunidad, el directivo de Sintraemcali FABIO BEJARANO y BERENICE CELEYTA, fueron a averiguar donde estaban los otros detenidos y pudieron constatar que se encontraban en un camión de la policía, rodeado de policía y ejercito y que los iban a conducir a una estación de policía.
    
   En este lugar un individuo se acerco a BERENICE y le expresó varias cosas frente a los hechos intentando responsabilizar a la policía, ante lo cual la defensora de derechos humanos no contesto nada y el en actitud sospechosa expreso "tranquila yo soy estudiante de sociología de la Univalle". Es importante resaltar que este mismo individuo fue el que la estuvo siguiendo dentro de la Universidad del Valle, luego de un foro de Desplazamiento Forzado.
    
8. Siendo las 7:30 p.m y cuando solo se encontraban muy pocas personas en el CAM, el coronel SUÁREZ salió y ante la denuncia que la presidenta de Nomadesc hacia de la actitud de la Fuerza Publica y que ella iba a denunciar todas estas irregularidades, según dos lideres de la comunidad que estaban ahí, el Coronel dijo en tono amenazante a un hombre de civil que lo acompañaba a todo momento: " blanco, blanco, blanco" y señalaba a BERENICE CELEYTA. Este hombre de civil fue el mismo que ordenaba a un agente de la policía que filmara, a los detenidos y a todos los que estuvieron solicitando la liberación de los detenidos.
    
   A esa misma hora el supervisor del CAM, CAMILO TORRES, fue requerido por unos agentes de la policía quienes le colocaron esposas, luego se las quitaron y lo pusieron a ordenes de el Coronel SUÁREZ quien lo condujo a la estación de FRAY DAMIÁN, a donde llegaron varios trabajadores, abogados y defensores de derechos humanos del Comité de Solidaridad con Presos Políticos y la Asociación Nomadesc.
    
   A las 9:30 p.m. y luego de varias gestiones efectuadas por el representante a la Cámara ALEXANDER LOPEZ, fueron liberados tres de los detenidos.

Antecedentes

1. A la madrugada de hoy 29 de enero, el CAM, amaneció acordonado y no existía ningún punto de sus cuatro entradas en las cuales se pudiera ingresar sin ser requisado por la policía.
2. A las 9:00 a.m. aproximadamente llegaron los funcionarios que instalarían la Tarima en el CAM, y dos miembros del Colectivo Teatral Luz de Luna, los agentes de policía, que acordonaban el CAM, les impidieron ingresar, según ellos por orden del comandante de la policía Coronel OSCAR NARANJO TRUJILLO, no existía permiso, para el evento, pese a que el Alcalde JHON MARO RODRÍGUEZ lo había autorizado.
3. A las 10:00 a.m cuando Sintraemcali, solicito a Nomadesc verificar el permiso, el Coronel YÁNEZ le expreso a BERENICE CELEYTA, que acababa de recibir confirmación del Alcalde. Berenice igualmente le manifestó que no se había permitido entrar algunos materiales de utilería, como los ladrillos que el colectivo que Luz de Luna, necesitaba dentro de su obra sobre desplazamiento forzado A-terra, como requerimiento para simular la ciudad a donde llegan los desplazados y este le dijo que no, inicialmente y luego accedió, pero que consultara con el Mayor ZÚÑIGA, con quien BERENICE solicito hablar y quien le expreso que no y que esperaba que no fuera una obra de Teatro subversiva y que incitará al desorden a la comunidad por que, si no la prohibía. Ante lo cual la defensora de derechos humanos le expreso que si el hacia eso tendría que tutelar algunos derechos que estaban siendo vulnerados como el derecho al espacio publico, la expresión, la recreación, la cultura y la protesta entre otros.

Solicitamos:

Se investigue imparcialmente los hechos en mención y si existen meritos se sancione a los miembros de la fuerza publica que estén comprometidos con las irregularidades aquí denunciadas.

Se solicite al gobierno colombiano derogar la resolución 141 por la cual se liquida EMCALI EICE y se cumplan los acuerdos del 29 de enero de 2002.
