DOMINGO TOVAR ARRIETA , Director of the CUT Human Rights Department and member of the National Executive of the CUT has been a recipient of the Ministry of Interior Protection Scheme for Trade Unions which was provided after presenting a case at the Organisation of American States. On 28th February DOMINGO TOVAR has decided to return his protective transport, bodyguards and weapons to the Ministry of Interior in protest at the failure of the Alvaro Uribe government to resolve inconsistencies concerning his scheme of protection. The Ministry of Interior has failed to provide petrol for the cars, and for that reason places DOMINGO's security at risk.

It should be noted that this takes place at a time when a confirmed and well funded plan to assassinate DOMINGO by paramilitary and delinquent groups working together was discovered. The decision to publicly return the security scheme is meant to highlight to the international and national community that the responsibility for DOMINGO's life and physical integrity lies with the government of President Alvaro Uribe Velez, and his functionaries.

"DEMOCRATIC SECURITY COONTINUES TO BE AN ATTACK FOR WORKERS AND THE PEOPLE." UP TO 26TH FEBRUARY THERE ARE NINE TRADE UNIONISTS ASSASSINATED - THE RESPONSIBILITY OF ALVARO URIBE, PRESIDENT OF COLOMBIA

The Central Unitaria de Trabajadores de Colombia CUT, through its Human Rights Department, once again denounces to the world the attacks against the trade union movement, especially those affiliated to the CUT. We call on people and organisations receiving this message to distribute it and to send messages of protest to the Colombian government.

ASSASSINATIONS

.. On 20th February, on the road between Albán and Bituima, the trade union leader JUAN ANTONIO BOHÓRQUEZ MEDINA from the Municipality of Bituima was kidnapped.
.. On 21st February, at 7:30 p.m. the worker from the Telephone Department of EMCALI E.I.C.E. and SINTRAEMCALI activist, FREDY PERILLA MONTOYA was intercepted by individuals in a white truck with polarised windows. They tried to force to go with them, but when he resisted, and they realised that they would not be able to complete their objective they shot him six times and fled.

SEARCHES - DETENTIONS

.. On the night of 19th February the house of RAFAEL PALENCIA FERNÁNDEZ was surrounded. He is an active member of the trade union SINTRAMINTRABAJO which is engaged in a court case representing freight workers against Coca Cola,. He is now being held by the SIJIN (intelligence police) in Cartagena, accused of belonging to urban militias of the insurgency,who were supposedly planning a terrorist attack against a businessmen's meeting in the city which will host President URIBE on the 20th and 21st of February 2003. According to the trade unionist he is being framed by the State Security Forces. On the same night the house of the educator and comrade from FECODE - SAMUEL REYES, was surrounded and a similar atempt to frame him is underway.
.. On 22nd February members of the secret police detained our comrade ROBINSON BELTRÁN HERRERA in Manizales. He is the President of the trade union of the Regional Electricity Corporation of the Atlantic Coast, SINTRAELECOL CORELCA; according to our sources an order for his capture was given by the Attorney of Cartagena,which was immediately carried out.

THREATS

.. On 17th February 11:30 a.m., a letter arived at the CIRCOLO COLO MBIANO DE REPORTEROS GRÁFICOS (GRAPHIC DESIGNERS GROUP) which contained a death threat against the President of the Trade Union GLADYS BARAJAS and her family.
.. On 20th February at 1:10 p.m, whilst the ex-President of SINTRAMUNICIPIO and civic leader from the Community Action Council in the Municipality of Vijes-Valle de Cauca ELBER ALBERTO GRANJA, was in the front garden of his house an individual began shooing at him. He fell to the ground and managed to escape unwounded after the individual was distracted by the presence of another person.
.. On 22nd February at 6.am, WILSON CASTRO PADILLA, member of SINALTRAINAL, was threatened in an anonymous letter using graphics taken from a newspaper, which stated that he must choose between his life and his famillies or continue in his trade union organisation.

The above barabarous events reflect the real situation of Colombia, where there is no respect for human rights, and where the principal culprit is the Colombian State, and the government headed by Doctor Álvaro Uribe Vélez, President of the Republic. There remains 100% impunity for the violators of human rights of the more than 3,800 crimes carried out in the last 16 years of existence of our trade union federation.

This dramatic situation of the trade union movement leads us to call on the solidarity of the the national and international community, Human Rights NGO's, trade unions and other organisations to denounce these crimes and demand that the Colombian government provides the necessary guarantees for us to carry out our trade union activity.

"LA SEGURIDAD DEMOCRÁTICA SIGUE GOLPEANDO A TRABAJADORES/AS Y AL PUEBLO"

A LA FECHA DE HOY 26 DE FEBRERO SON NUEVE LOS SINDICALISTAS ASESINADOS-RESPONSABILIDAD DE ALVARO URIBE PRESIDENTE DE COLOMBIA

La Central Unitaria de Trabajadores de Colombia CUT, a través del departamento de Derechos Humanos, una vez más denuncia ante el mundo en general, la arremetida contra el movimiento sindical y en especial con el afiliado a la CUT, solicitando la colaboración de persona u organización que reciba este comunicado en multiplicarlo y a la vez enviar mensajes de protesta al gobierno colombiano por su responsabilidad como Estado en estos hechos:

ASESINATOS

El día 20 de febrero, en la vía que conduce de Albán a Bituima, fue secuestrado el directivo sindical del municipio de Bituima, Licenciado JUAN ANTONIO BOHÓRQUEZ MEDINA, afiliado al sindicato de FECODE - CUT, quien trabajaba en el municipio de Albán, Cundinamarca y tres días después fue encontrado vilmente asesinado en jurisdicción del municipio de Albán.
El día 21 de febrero, siendo las 7:30 p.m. el trabajador de la Gerencia de Teléfonos de EMCALI E.I.C.E. y activista de SINTRAEMCALI, FREDY PERILLA MONTOYA quien fue interceptado por individuos que se transportaban en una camioneta blanca polarizada, quienes intentaron forzar al compañero y subirlo al carro, el compañero se opuso y forcejeo con ellos, al ver que no lograban su objetivo de llevárselo, le propinaron seis disparos y emprendieron la huida.

ALLANAMIENTOS - DETENCIONES

El miércoles 19 de febrero en horas de la noche fue allanada la residencia del compañero RAFAEL PALENCIA FERNÁNDEZ, miembro activo del sindicato de trabajadores SINTRAMINTRABAJO, quien adelantaba procesos de demanda de los compañeros fleteros contra la Transnacional Coca Cola. En estos momentos en compañero se encuentra detenido en los calabozos de la SIJIN en Cartagena, acusado de pertenecer supuestamente a las milicias urbanas de la insurgencia y estar planificando posibles actos terroristas en la cuidad con ocasión de la cumbre de empresarios con el presidente URIBE realizada los días 20 y 21 de febrero de 2003, cuando según versiones del compañero fue objeto de un vil montaje por parte de las fuerzas de seguridad del estado.
Esa misma noche del 19 de febrero, fue allanada la residencia del compañero educador afiliado a FECODE - SAMUEL REYES, haciéndole los mismos montajes que al compañero Palencia.
El día 22 de febrero fue retenido por miembros de la policía secreta en forma sospechosa y desconsiderada en la cuidad de Manizales, el compañero ROBINSON BELTRÁN HERRERA, Presidente del Sindicato de Trabajadores de la Corporación Regional Autónoma de la Costa Atlántica Otrora Corelca, SINTRAELECOL CORELCA; pues según estos organismos fueron notificados de una orden de captura vigente por un Fiscal en Cartagena, la cual ejecutaron de inmediato.

AMENAZAS

El día 17 de febrero a eso de las 11:30 a.m., llegó a las oficinas del CIRCULO COLOMBIANO DE REPORTEROS GRÁFICOS, un sobre enviado por correo que contenía una carta y un sufragio donde se amenaza a la presidenta del sindicato GLADYS BARAJAS y a su familia.
El día jueves 20 de febrero, siendo la 1:10 p.m., cuando el dirigente sindical y líder cívico ELBER ALBERTO GRANJA, expresidente de SINTRAMUNICPIO YUMBO y en la actualidad es Presidente de la Junta de Acción Comunal del Municipio de Vijes - Valle del Cauca, se encontraba en el anden de la su casa, el dirigente observó a un individuo que desenfundo un arma de fuego y comenzó a disparar hacia él, en esos momentos por la calle bajaba un muchacho quien fue testigo de los hechos y se protegió de los disparos acercándose a la casa del compañero, quien se había tirado al suelo, saliendo ileso.
El día 22 de febrero siendo aproximadamente las 6 a.m., es amenazado el compañero WILSON CASTRO PADILLA, afiliado al sindicato de SINALTRAINAL, por medio de un anónimo montado con letras de periódico, siendo encontrado por su señora esposa cuando se disponía a abrir la puerta de su casa, en el cual lo ponen a escoger entre su vida y la familia o seguir en la organización.

Los anteriores hechos de barbarie reflejan la situación real de Colombia, que no existe un respeto por los Derechos Humanos y donde el principal responsable de esta barbarie es el Estado, con el Gobierno a la cabeza del Doctor Álvaro Uribe Vélez, Presidente de la República. Con el precedente que continua la impunidad en el 100% de los más 3.800 crímenes llevados a cabo en 16 años de existencia de nuestra Central.

Toda esta situación dramática del movimiento sindical nos lleva a solicitarle solidaridad a la Comunidad internacional y nacional, ONG's de derechos humanos, sindicatos y demás entidades que denuncien estos crímenes y exijan al Gobierno Colombiano reales garantías para continuar con nuestra actividad sindical.

Yo DOMINGO TOVAR ARRIETA identificado con cédula de ciudadanía No.9.309.324 de Corozal - Sucre, Miembro del Comité Ejecutivo Nacional de la CUT en el cargo de Director del Departamento de Derechos Humanos, con medidas cautelares solicitadas por la Comisión Interamericana de Derechos Humanos de la OEA, hoy protegido por el programa de protección del Ministerio del Interior para dirigentes sindicales y defensores de derechos humanos, pongo en conocimiento de ustedes lo siguiente:

? Cuento con un esquema duro de protección por mi situación de riesgo, es decir un carro blindado y cuatro escoltas con sus respectivas armas; hoy 28 de febrero he sido notificado por el señor ANTONIO RODRÍGUEZ, Director de Transportes del Departamento Administrativo de Seguridad DAS, que no hay combustible, (gasolina) para el carro de mi esquema de protección, argumentando que es un problema administrativo del Ministerio del Interior en la persona del Doctor CESAR FANDIÑO, situación corroborando por el Doctor WILSON SAN JUAN Director de Protección del DAS; he hablado con ambos funcionarios y evaden la responsabilidad dándosela el uno al otro, pero ninguno me responde por el combustible para el carro, en fin son gobiernos estos funcionarios y el responsable directo es el gobierno.

Esto sucede cuando he sido alertado de un plan para asesinarme en el cual se dice que han pagado una suma considerable de dinero que el plan será ejecutado entre el paramilitarismo y la delincuencia común siendo más preocupante mi situación de seguridad, y la que había comentado confidencialmente a algunos funcionarios del gobierno.

He decidido como no hay combustible para el carro, públicamente entregarlo al gobierno, Ministerio del Interior y DAS, conjuntamente con los escoltas, dejando claro ante la opinión pública nacional e internacional que es responsabilidad del gobierno del Doctor ALVARO URIBE VELEZ y sus funcionarios lo que pase con mi vida e integridad física.

Acudiré a todos los escenarios públicos nacionales e internacionales ha denunciar mi situación de inseguridad, contrario a los informes que presenta el gobierno en el campo internacional.
