The Peace and Human Rights Commission of USO denounces before national and international public opinion the disappearance of a student at the Javeriana University in Cali. He is MARLON MINA GAMBI, the son of YESID MINA, a worker at the Ecopetrol oil refinery in Cartagena and a member of USO. The student has been disappeared since about 7 p.m. on Monday 5th May, when he was last seen in the barrio of Buenos Aires in Cali.

We think that this action brings to a head the continuous threats and assassination attempts on USO members, given that the paramilitary groups issued a communique last week announcing that "we declare all the USO union leaders and the children of USO members to be military targets, awe have already started actions against the workers' children".

We demand that those who have Marlon in their power respect his life and that they release him immediately, and that the national government responds to the family members and the union.

The following message was received on 6th May 2003 in the electronic mail of a member of the Cartagena (Bolívar) Section of USO:

CONTEXT

This message appears 5 months after USO presenetd its Set of Demands to the managment of the Colombian State Oil Corporation - Ecopetrol. Although the management expressed a conciliatory attitude they called for an Arbritartion Tribunal and for a military occupation of the refineries in Barrancabermeja and Cartagena; they have detained and carried out other agressions against the union, combining this with a new judicial process against union leader HERNANDO HERNANDEZ who now lives under house arrest and almost 60 other cases against workers for carrying out trade union activity in the state corporation.

In the light of this whole background, the workers are about to dcalrea STRIKE for their own political defence and to safeguard the nation's wealth from the government's obstinate policy of trying to privatise the oil business, and so hand the country's natural resources over to the multinationals and snatch away the rights that have been won by the workers over eighty years of struggle.

DEMANDS

1.. That the national government guarantees the life, security and integrity on members of USO, especially of the workers in the union's Cartagena (Bolívar) Branch, as well as their families.

2.. That concrete results are evidenced in the investigation being carried out into the harrassment that USO members have been subject to.

3.. That the national government authorities recall the obligations they entered with respect to protection of unionised workers, and that they immediately take the necessary and effective measures to guarantee that USO members can carry out the political and social work they are developing without danger. This demand is in keeping with ILO norms and the international precepts that protect and endorse the work of the trade union movement.

DESAPARECIDO ESTUDIANTE EN CALI

La Comisión de Paz y Derechos Humanos de la USO, denuncia ante la opinión publica nacional e internacional la desaparición del estudiante de la Universidad Javeriana de Cali MARLON MINA GAMBI, hijo de YESID MINA, trabajador de Ecopetrol en la refinería de Cartagena y afiliado a la USO. El estudiante se encuentra desaparecido desde aproximadamente las 7 p.m., del lunes 5 de Mayo, en el bario Buenos Aires de la ciudad de Cali, donde fue visto por ultima vez.

Pensamos que esta acción se suma a los continuos atentados y amenazas contra los afiliados de la USO, ya que en comunicado de grupos paramilitares enviado esta semana, anunciaban que "declaramos objetivo militar a todos los líderes sindicales e hijos de trabajadores suscritos a la USO, ya comenzamos nuestras acciones contra los hijos de los trabajadores".

Exigimos a quienes tengan en su poder a Marlon, le respeten la vida, lo pongan en libertad en forma inmediata y al gobierno nacional responder antes los familiares y el sindicato por el hijo del trabajador afiliado a nuestra organización sindical.

El día 6 de mayo de 2003 fue recibido a través del correo electrónico de un miembro de la USO de la Seccional Cartagena (Bolívar) el siguiente mensaje:

CONTEXTO

Este mensaje aparece después de 5 meses de haberse presentado Pliego de Peticiones por parte de la UNION SINDICAL OBRERA DE LOS TRABAJADORES DEL PETROLEO -USO- a la Administración de la Empresa Colombiana de Petróleos -Ecopetrol-.; sin que hasta el día de hoy por parte de la administración de dicha empresa se exprese un ánimo de conciliación y en su lugar se responde con el llamamiento a un Tribunal de Arbitramento y a la militarización de las refinerías de Barrancabermeja y Cartagena presentándose detenciones y agresiones contra trabajadores del Sindicato, aunado a esto se presenta una nueva judicialización contra el dirigente del sindicato HERNANDO HERNANDEZ quien actualmente se encuentra en detención domiciliaria y el inicio de casi 60 procesos disciplinarios en contra de los trabajadores de la estatal petrolera por hacer efectivo el ejercicio de su actividad sindical.

De acuerdo con el panorama anterior, los trabajadores en un acto de defensa política y social del patrimonio de la Nación se están viendo obligados a decretar la HUELGA, debido a la obstinada actitud del gobierno nacional de privatizar el negocio del petróleo, de entregar el recurso petrolero nacional a las multinacionales y arrebatar los derechos adquiridos por los trabajadores durante ochenta años de lucha.

PETICIONES

1.. Que el gobierno nacional garantice la vida, la seguridad e integridad de los miembros de la UNION SINDICAL OBRERA DE LA INDUSTRIA DEL PETROLEO -USO-, en especial de los trabajadores de la Seccional Cartagena (Bolívar), así como el de sus familias.

2.. Que se evidencien resultados concretos en las investigaciones que se adelantan por los hostigamientos a los que se han visto sometidos los miembros de la UNION SINDICAL OBRERA DE LA INDUSTRIA DEL PETROLEO -USO-.

3.. Que las autoridades del gobierno nacional recuerden las obligaciones contraidas con respecto a la seguridad y protección de los trabajadores sindicalizados y tomen a partir de estas, las medidas inmediatas, necesarias y efectivas para garantizar que los miembros de la USO puedan llevar a cabo sin peligro, la labor de exigencia política y social que desarrollan. Esta petición de acuerdo con la normatividad de la OIT y los preceptos de carácter internacional que protegen y respaldan la labor del movimiento sindical.
