The Spanish multinational UNIÓN FENOSA, owner of Electrocosta and Electricaribe, has presented to the Minister of Social Protection for the Atlántico and Bolívar region, a request for authorisation to sack 673 workers with collective agreement rights working in Magdalena, Cesar, Guajira, Atlántico, Bolívar, Sucre and Córdoba departments. This is clear evidence of its machiavellian intention to carry out a new labour massacre on the workers movement, ruthlessly laying waste to all social sectors and putting in danger the peace that is so yearned for in this part of the country.

Considering that permanent labour peace can only be based on social justice, we believe that the working conditions entail such a high degree of injustice, misery and privations for a large number of workers, the discontent caused constitute a threat to the peace and harmony in the corporations to such an extent that it is urgent to improve conditions. We consider the ILO Declaration that affirms THAT ALL HUMAN BEINGS WITHOUT DISTINCTION OF RACE< CREED OR SEX HAVE THE RIGHT TO PURSUE THEIR MATERIAL WELL BEING AND THEIR SPIRITUAL DEVELOPMENT IN CONDITIONS OF FREEDOM AND DIGNITY, OF ECONOMIC SECURITY AND EQUALITY OF OPPORTUNITY.

Moreover we consider that discrimination constitutes violation of human rights enunciated in the Universal Declaration of Human Rights. In the permanent abuses and humiliations heaped upon the workers and users of Electrocosta and Electricaribe, these SPANISH have even exceeded the abuses they administered on our ancestors in the past.

The violations that these corporations belonging to the multinational UNION FENOSA DE ESPAÑA, are aimed at the workers in this region, sustained in concepts that violate the fundamental principles of the Colombian Constitution, international agreements, laws and norms of international humanitarian law. There has been systematic violation of existing collective agreements, contradicting the good faith and high degree of professional responsibility that can be found in the human resources of Latin America, by FRANCISCO AVENDAÑO, the Spanish citizen in charge of labour relations. .We consider that the means of improving working conditions and guaranteeing peace and the freedom of expression and association, essential for constant progress in the organic life of the company and its workers.

Ignoring worker - employer relations is evident in the following examples:

• Flagrant violation of the rights to association, work and negotiation and a dignified wage.
• In 1998 the staffing level under the collective agreement was 4,372 workers. Currently it is 1,604 workers. This is due to the policy of elimination of unionised workers implanted by the Spanish in Electrocosta and Electricaribe.
• Ignoring the law and collective work agreements, workers are being sacked for poor performance, although these sackings have no substance or legal justification. Take into account that inside these plants there are 5,800 contract workers, and more than 315 officials with so-called corporate work contracts giving many of them salaries of up to $ 15.000.000 pesos [more than £5,000] monthly, and another 417 work with co-operatives belonging to the Spanish group UNION FENOSA.

In equal fashion, the users (misleadingly called 'clients') have been super-exploited, attacked and tricked. From their arrival the Spanish promised expansion of the energy service to the subnormal sectors and the villages, but up to this day they have only built one section of primary or secondary lines. Meantime they have had campaigns to revise and market new metres ( "montoyas" ), cables and boxes for the metres, and applied punishments for fraud when there has not been any, subjecting the people of the coast to the worst humiliation.

WE ASK FOR SOLIDARITY FROM THE TRADE UNIONS and CIVIC-POPULAR MOVEMENT, and from the LIVE FORCES IN THE COMMUNITY in general, to defeat the Spanish invaders who daily flagellate and violate our laws, our Constitution, international agreements and the dignity and honour of the people of the coast, el pueblo costeño.

A LA OPINIÓN PUBLICA

DENUNCIAMOS:

QUE la multinacional UNIÓN FENOSA DE ESPAÑA, propietaria de las empresas Electrocosta y Electricaribe, ha presentado ante el Ministerio de Protección Social Regional Atlántico y Bolívar, la solicitud de autorización de despido de 673 trabajadores convencionados, que laboran en los departamentos de Magdalena, Cesar, Guajira, Atlántico, Bolívar, Sucre y Córdoba, poniendo claramente en evidencia su maquiavélica intención de perpetrar una nueva masacre laboral contra el movimiento obrero, así como ha venido asolando despiadadamente a toda las esferas sociales poniendo en peligro la paz tan anhelada en esta región del país.

Considerando que la paz laboral permanente solo puede basarse en la justicia social, creemos que existen condiciones de trabajo que entrañan tal grado de injusticia, miseria y privaciones para un gran numero de trabajadores, el descontento causado constituye una amenaza para la paz y armonía empresarial, a tal grado, que es urgente mejorar dichas condiciones. Consideramos que la declaración de la OIT, afirma que TODOS LOS SERES HUMANOS, SIN DISTINCIÓN DE RAZA, CREDO O SEXO TIENEN DERECHO A PERSEGUIR UN BIENESTAR MATERIAL Y SU DESARROLLO ESPIRITUAL EN CONDICIONES DE LIBERTAD Y DIGNIDAD, DE SEGURIDAD ECONÓMICA Y EN IGUALDAD DE OPORTUNIDADES. Considerando además, que la discriminación constituye la violación de los derechos enunciados por la Declaración Universal de los Derechos Humanos en los permanentes abusos y humillaciones que vienen soportando los trabajadores y usuarios por parte de Electrocosta y Electricaribe, ha rebasado los abusos que en el pasado, estos ESPAÑOLES, le propinaron a nuestros ancestros.

Las violaciones que estas empresas, pertenecientes a la multinacional UNION FENOSA DE ESPAÑA, le vienen asestando a los trabajadores de esta región del país, sustentadas en conceptos que violan los principios fundamentales emanados de la Constitución Política de Colombia, convenios internaciones, leyes y normas derivadas de derecho internacional humanitario, así como la violación sistemática de los acuerdos y las convenciones colectivas de trabajo vigentes, desdicen de la buena fe y el alto grado de responsabilidad profesional que debe orientar desde la dirección de recursos humanos para América Latina el señor FRANCISCO AVENDAÑO, ciudadano español encargado de las relaciones laborales. Consideramos que los medios susceptibles para mejorar las condiciones de trabajo y de garantizar la paz, son la libertad de expresión y de asociación, estos son esenciales para el progreso constante de la vida orgánica de la compañía y de sus trabajadores.

El desconocimiento total de las relaciones obrero patronal es evidente en los siguientes ejemplos:

• Violación flagrante al derecho de asociación, trabajo, negociación y a un salario digno.
• La planta de personal convencionada sustituida patronalmente en 1998 era de 4.372 trabajadores. Actualmente es de 1.604, ante la política de exterminio implantada por los españoles en Electrocosta y Electricaribe a los trabajadores sindicalizados.
• Desconocimiento de la ley, convenciones colectivas de trabajo, en la aplicación de despidos por bajo desempeño, sin que estos despidos tengan alguna justificación ni sustentación legal, teniendo en cuenta que al interior de estas empresas hay 5.800 contratistas y más de 315 funcionarios con contratos de trabajo llamados corporativos, donde muchos de estos devengan salarios hasta de $ 15.000.000 mensuales y otros 417 laboran con cooperativas pertenecientes a los mismos españoles del grupo UNION FENOSA.

De igual forma, han venido superexplotando, atropellando y engañando a los usuarios, hoy mal llamados clientes, a quienes desde su llegada prometieron la expansión en el servicio de energía en los sectores subnormales y veredas, sin que hasta la fecha hayan construidos un solo tramo de línea primaria o secundaria. Así mismo han promovido campañas de revisión y comercialización de medidores "montoyas", cables, cajas para los medidores, aplicando sanciones sobre fraudes, donde no los hay, sometiendo al pueblo costeño a la más aberrante humillación.

SOLICITAMOS la SOLIDARIDAD DEL MOVIMIENTO SINDICAL, CÍVICO - POPULAR y de las FUERZAS VIVAS DE LA COMUNIDAD en general, para derrotar la agresión de los españoles invasores que a diario flagelan y violan las leyes, Constitución Política de Colombia, convenios internacionales, dignidad y honra del pueblo costeño.
