In the best tradition of the mafia who like to give their victims a final coup de grâce, the government of Uribe Vélez issued decree No 1760 on 26 June which divides state oil corporation ECOPETROL in three parts. The decree ends ECOPETROL's status as and Industrial and Commercial State Corporation, turning it into a company whose owners will be its shareholders. The company's function will not be to manage hydrocarbons, but to promote energy. The company's future will be in the hands of shareholders and not the Colombian people. In the words of Luis Ernesto Mejía, minister of Mines and Energy “ECOPETROL will not be the same company after the decree".

For ECOPETROL as such, the days are numbered. The corporation is already no longer the common property of Colombians, rather its shares are held by the Treasury (loyal agent of the IMF), a trust fund called PREVISORA S.A. and FONADE, AUDIOVISUALES, FINDETER as well as other public entities with the legal right to participate. There is an opening for the workers to become shareholders, although they are not doing so unlike [Minister] Fernando Londoño, [ECOPETROL President] Isaac Yanovich, [president of the coffee exporters' association] Jorge Lozano and other men used to the investment banking business

The corporation will manage the 300 million barrels of direct oil reserves that it already has, plus 500 million barrels through Contracts of Association [with private companies]. Thee reserves will run out in 3 years given a consumption rate of 250 million barrels a year, up to which time its exploration and production activity will end. Oil refineries will be abandoned, with their backward technology and precarious maintenance and with a yield of just $1.8 per barrel (one of the lowest in the world) they will lose out in the unequal competition with importers. that leaves some oil pipelines and gas lines open to competition from the multinationals, who use ECOPETROL's infrastructure to tie the corporation down to their needs. And this will be managed by administrators who only look to fill their own pockets with the proceeds of sub-contracting, the black hole of corruption.

These new conditions mean that ECOPETROL. S.A., will be a mockery of a corporation. Meanwhile, to the multinationals will go the new National Hydrocarbon Agency, a type of association between the government and the foreign companies that will have all the geological information - the library, the database of available land and the services of 70 staff. With these measures legal control is returning to the old concession system, which is what the US Embassy in Colombia has been demanding for some time.

It is aggravating that there is less knowledge of the oil industry in this government than there has ever been in our country's history. Yet the government is most willing to hand over the to the North American empire whatever it asks for, and even what it has not asked for. Examples abound: the multinationals demanded the exclusive recognition of 5 patents for their pharmaceutical industry and Uribe gave them 8; he was very solicitous in supporting the US invasion of Iraq; and although the previous governments of Samper and Pastrana were submissive and servile towards the United States, it did not dare to ask them to hand over ECOPETROL, while Uribe is handing it over cut up into three pieces.

We are faced with a president who shows no restraint in his actions, and he is surrounded with people like Yanovich and Mejía, Minister of Mines, who when they publicly contradict Uribe are made to retract. They are imposing serious decisions on the country while they keep secret who is sponsoring the business.

The decree to restructure ECOPETROL will give birth to the National Hydrocarbon Agency, ECOPETROL S.A. and the Colombian Energy Promotion Association S.A.. They are all a bad piece of work. This a very serious for national sovereignty, and should be categorically and energetically rejected. As a consequence USO has declared itself in Permanent Assembly of Patriotic Resistance and Dignity throughout the country, demanding of the government and the corporation's administration a solution to this new conflict facing the nation

USO calls for the defence of public goods. We ask different sectors of Colombian society to pronounce against this attack on national sovereignty. With this measure oil fields like Caño Limón, Cocorná, Cusiana, Cupiagua and others will revert [to private hands], never to return to the nation. ECOPETROL S.A.'s constitution chops some 3.7 million, million pesos from the former corporation's assets. The new corporation will leave the country's potential reserves at a marginal level. They are only 48 thousand million barrels due to the low levels of exploration undertaken in recent years. And the problem of the workers, whose work contract and labour conditions will be at the discretion of the corporation's president: Mr. Yanovich, a person who has already manifest a demented hatred for the workers. Nothing is guaranteed, all remains uncertain until the first shareholders meeting, the highest authority of ECOPETROL. S.A. which will define the conditions and character of the workforce.

The struggle of patriotic resistance and dignity continues, with greater vigour and determination.

URIBE DA GOLPE DE GRACIA A ECOPETROL

Al mejor estilo de la mafia que ultima a sus víctimas con el tiro de gracia, el gobierno de Uribe Vélez le acaba de dar ese golpe a ECOPETROL, mediante el decreto No1760 del 26 de junio del año en curso, por medio del cual, divide y escinde en tres a la Empresa Colombiana de Petróleos y acaba su naturaleza de Empresa Industrial y Comercial del Estado, para convertirla en una empresa por acciones, cuyos propietarios a partir de la fecha serán sus accionistas, escindió el manejo de los hidrocarburos y creó una empresa promotora de energía, acto con que dio sustento a las palabras del señor Luis Ernesto Mejía, ministro de Minas y Energía. “Ecopetrol no será la misma empresa después de los decretos”, . su suerte dependerá de sus accionistas y no de los colombianos.

ECOPETROL tal como quedó tiene los días contados. Esta empresa ya no es patrimonio de los colombianos, porque sus acciones quedaron en manos del Ministerio de Hacienda,- léase agente del FMI-, la fiduciaria la PREVISORA. S.A., FONADE, AUDIOVISUALES, FINDETER u otras entidades públicas con facultades jurídicas para participar y una puerta abierta para que entren trabajadores y ex trabajadores aunque no lo sean, como Fernando Londoño, Isaac Yanovich, Jorge Lozano y uno que otro avezado hombre de negocios de la banca de inversión.

La empresa manejará los 300 millones de barriles de petróleo de reservas directas que tiene hoy y los 500 millones de su participación en los Contratos de Asociación, estas reservas se agotarán en 3 años a una rata de consumo anual de 250 millones de barriles de petróleo y pare de contar, hasta ahí llegará su actividad exploratoria y de producción. Tendrá unas refinerías abandonadas, con atrasos tecnológicos y precario mantenimiento que con un margen de rendimiento de 1,8 dólares promedio por barril de petróleo cargado (uno de los niveles más bajos del mundo), saldrá del mercado en la competencia desigual con los importadores. Le dejan unos Oleoductos y Poliductos abiertos a la competencia de las multinacionales, que utilizan la infraestructura de ECOPETROL para amarrar la empresa a las necesidades del importador. Y será manejada por unos administradores que solo miran hacia sus bolsillos a través de la contratación, agujero negro de la corrupción.

Estas nuevas condiciones hacen que ECOPETROL. S.A., sea un remedo de empresa. Entre tanto, a las multinacionales les quedó la banda ancha de la AGENCIA NACIONAL DE HIDROCARBUROS, una especie de asociación entre el gobierno y las compañías extranjeras, que dispondrán de la información geológica de la Litoteca, el banco de tierras disponibles para su inversión y los servicios oficiosos de los 70 burócratas que manejarán la agencia y se disponen a regresar la legislación petrolera al viejo sistema de concesión que ha venido exigiendo la embajada norteamericana en Colombia, con un agravante, que este gobierno es el que menos conocimiento tiene en materia petrolera en la historia del país, pero el más acucioso a entregarle al imperio del norte lo que pide y hasta lo que no le han pedido. Los ejemplos abundan: las multinacionales exigieron el reconocimiento exclusivo de 5 patentes de su industria farmacéutica y Uribe les entregó ocho, fue muy solícito en apoyar la invasión gringa a Irak, a Samper y Pastrana con todo lo sumisos y serviles que fueron sus gobiernos a los Estados Unidos y este les pidió entregar ECOPETROL y no se atrevieron, mientras ahora Uribe la entrega dividida en tres.

Estamos ante un presidente que no se mide en sus acciones y lo rodean otros como Yanovich y Mejía, presidente de ECOPETROL y Ministro de minas, que lo desmienten en público, lo hacen retractarse y le imponen determinaciones graves para el país, cual padrino cuyos compadres le guardan secretos y negocios.

La Agencia Nacional de Hidrocarburos, ECOPETROL S.A. y la Sociedad Promotora de Energía de Colombia S.A., engendros nacidos del decreto de reestructuración de ECOPETROL, son hechos graves para la soberanía de la Nación, que tienen que ser rechazados con energía y contundencia. En consecuencia la U.S.O. se ha declarado en Asamblea Permanente de Resistencia Patriótica y Dignidad en todo el país, exigiendo al gobierno y a la administración de la Empresa una solución a este nuevo conflicto que le aparece a la nación.

La U.S.O., en un llamado por la defensa de los bienes públicos, pide que los diferentes sectores de la sociedad colombiana se pronuncien frente a este atentado contra la soberanía de la Nación, porque con esta medida, los Campos próximos a revertir como Caño Limón, Cocorná, Cusiana, Cupiagua y otros, jamás retornarán a la nación. En la constitución de Ecopetrol S.A., le quitan de tajo a la otrora ECOPETROL 3,7 billones de pesos de su patrimonio. Esta empresa S.A. queda marginada del potencial de reservas del país, estimado en 48 mil millones de barriles de petróleo debido al bajo nivel exploratorio al que la han sometido los gobiernos en los últimos años. Y el problema de los trabajadores, cuyos contratos de trabajo y condiciones laborales están a discrecionalidad del presidente de la empresa: el señor Yanovich, personaje que ejerce su odio de clase demencial hacia los obreros. Nada está garantizado, todo queda en la incertidumbre hasta que la primera asamblea de accionistas, máxima autoridad de ECOPETROL. S.A. defina las condiciones y carácter de sus trabajadores.

La lucha de resistencia patriótica y dignidad continúa, con mayor vigor y determinación.
